JOINT RESOLUTION AND AGREEMENT N0.-_4; :. 4,-, STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS COUNTY OF TARRANT § WHEREAS, the City of Fort Worth is a home rule City lying and being situated within the confines of the County of Tarrant, State of Texas, and WHEREAS, the City of Benbrook is a home rule City lying and being situated within the confines of the County ,of Tarrant, State of Texas, and WHEREAS, the City of Fort Worth and the City of Benbrook desire to adjust their extraterritorial jurisdiction and corporate boundary lines to facilitate the development and maintenance of property within their respective jurisdictions, NOW THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF BENBROOK 1. That the following extraterritorial jurisdiction and corporate boundary realignment between the City of Fort Worth and the City of Benbrook, as hereafter described, is in the best interests of the property owners and inhabitants of both cities and that the City of Fort Worth and the City of Benbrook will proceed with due diligience in adopting the necessary disannexation and annexation ordinances adjusting their respctive corporate boundaries and all other proceedings necessary to effectuate this agreement. 2. That the City of Fort Worth and the City of Benb rook do hereby covenant and agree to protect, preserve and defend the hereinafter described realignment. - 3. That the City of Fort Worth hereby agrees to discontinue from its corporate boundary and to release all its jurisdictional rights it has or may have in and to all territories embraced within the area shown on map Exhibit "A", attached hereto and made a part hereof, and described by metes and bounds as follows f:. r,: . AREA TO BE DISANNEXED BEING approximately 12.2 acres situated in the HAYS COVINGTON SURVEY, Abst. No. 257 and the C. A. KUYDENDALL SURVEY, Abst. No 890, City of Fort Worth, Tarrant County, Texas, being a portion of that certain tract of land conveyed to Belgian American Investments and Trade, Inc. by deed recorded in Volume 7658, Page 1588, Tarrant County Deed Records, also being a portion of a 100-foot wide strip of land annexed by the City of Fort Worth, December 23, 1968, by City Ordinance No. 6036, said 12.2 acres being more particularly described by metes and bounds as follows BEGINNING at a point in the north line of said Belgian American Investments and Trade, Inc. tract, and the s outh line of the Texas and Pacific Railroad R.O.W., said point being S 59°20 ' 51" W, approximately 510 feet from the south line of Interstate Hi ghway No. 20, said point -also being N 59° 20' 51 E, approximately 1 316.4 feet from the northeast corner of a tract of land conveyed to Texas Electric Service Co, by deed recorded in Volume 5419, Page 791, Tarrant County Deed Records, THENCE N 59° 20' 51" E, along the north line of said Belgian American Investments and Trade, Inc., tract and the south line of said T&PRR R.O.W., approximately 350 feet to a point in the centerline of Walnut Creek, THENCE Southwesterly along the approcimately 5600 feet to a point American Investments and Trade, west line of said KUYKENDALL SURVEY ELLIOTT SURVEY, Abst. No. 495, centerline of said Walnut Creek in the west line of said Belgian n.c., tract, said point being in the and in the east line of the J. F. J THENCE N 00° 05' 27" E, along the west line of said KUYKENDALL SURVEY and the east line of said ELLIOTT SURVEY, and along the west line of said Belgian American Investments and Trade, Inc. tract, approximately 85 feet to a 5/8" iron in the south line of said Texas Electric Service Co. tract, THENCE N 61° 32' 40" E, along the north line of -said Belgian American Investments and Trade, Inc. tract, and the south line of said TESCO tract, approximately 110 feet to a point, THENCE Northeasterly, parallel to and 100 feet west of the centerline of said Walnut Creek, approximately 5020 feet to the POINT OF BEGINNING and CONTAINING approximately 12.2 acres of land. AREA TO BE RELEASED FROM ETJ BEING approximately 36.5 acres situated in the HAYS COVINGTON SURVEY, Abst. No 257 and the C. A. KUYKENDALL SURVEY, Abst. No. 890, Tarrant County, Texas, s aid 36.5 acres being a portion of that certai n tract of land conveyed to Belgian American Investments and Trade, Inc. by deed recorded in Volume 7658, Page 1588, Deed Records, Tarrant County, Texas and being more particularly described by metes and bounds as follows f BEGINNING at a point in the north line of said Belgian American Investments and Trade, Inc. tract, and the south line of the Texas and Pacific Railroad R.O.W., said point being N 59°20'51" E, approximately 1316.4 feet from the northeast corner of a tract of land conveyed to Texas Electric Service Co. by deed recorded in Volume 5419, Page 791, Tarrant County Deed Records said point being 100 feet west of the centerline of Walnut Creek, THENCE southwesterly parallel to and 100.00 feet west of the centerline of said Walnut Creek, approximately 5020 feet to a point in the north line of said Belgian American tract and the south line of said TESCO tract, THENCE along the common line of said Belgian American and said TESCO tracts as follows- N 61° 32' 40" E, approximately 2777.8 feet to a 1/2" iron, N 30° 40' 59', a distance of 412.50 feet to a 112" iron in the south line of said T&PRR R.O.W., THENCE N 50°20'51" E, along the south line of said T&PRR R.O.W., approximately 1316.4 feet to the POINT OF BEGINNING and CONTAINING approximately 36.5 acres of land. 4. That the City of. Benbrook hereby agrees to annex the property disannexed and released from the ETJ by the City of Fort Worth as described herein and shown on map Exhibit "A", and the City of Benbrook agrees to assume the rights and obligations appurtenant to said property. 5. That these terms and conditions set forth shall become effective and binding on Fort Worth and Benbrook by the adoption of this Joint Resolution and Agreement in regular and open City Council meetings of the City of Fort Worth and the City of Benbrook, and that this Joint Resolution and Agreement, upon adoption of both cities, shall be executed in several originals and shall be spread in full on the minutes of each city. A copy of this Joint Resolution and Agreement shall be executed by the Mayor and attested by the City Secretary of each city.
