WHEREAS, all abutting property owners have requested, by written
and signed petition, that the City physically close, at
such property owners' expense, the east/west alley located
in Block 91, Texas and Pacific Railroad Addition, adjacent
to Lots 1 through 4 and 13 through 16, between Cedar
Street and the west boundary line of Lots 4 and 13 in said
Addition; and
WHEREAS, the Plan Commission of the City of Fort Worth has reviewed
this request and recommends that the subject alley be
closed as requested: NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
That the existing east/west alley located adjacent to Lots 1
through 4 and 13 through 16 in Block 91, Texas and Pacific Railroad
Addition, between Cedar Street and the west boundary line of Lots 4
and 13, Block 91, Texas and Pacific Railroad Addition, be physically
closed with locked gates at the abutting property owners' expense;
the City of Fort Worth shall, however, retain all its existing
rights in and title to said alley and any and all easements therein
for existing and prospective utilities, with all necessary and
reasonable rights of access thereto.
In addition, the City in its sole discretion reserves the right
to adopt a resolution reopening the alley to the public at any time
and to direct the removal of the locked gates with the cost and
expense of said reopening, including the removal of the gates, to be
borne by the property owners ;ting said alley.
