SUBJECT: RESIDENTIAL SOLID WASTE COLLECTION SERVICES UPDATE

City Council requested information about the current Residential Solid Waste Collection Services
Contract with Waste Management regarding the current term, services provided and level of
services.
Current Residential Collections Agreement
The existing contract for collection of residential garbage, bulk waste, recyclables, certain limited
commercial solid waste, yard waste and large brush with Waste Management of Texas began on
January 8, 2003 for an initial 10 year period. The contract allows up to three 10 year extensions.
On January 29, 2013, City Council approved the first 10-year extension which ends on March 31,
2023, unless City Council approves extending the contract for a second 10-year period. Waste
Management of Texas and Knight Waste Services, as the required Minority/Women Business
Enterprise (MWBE) subcontractor (25% of the total dollar value of the contract), provides weekly
garbage, recycling and yard waste collections and once a month bulk waste & large brush
collections, as well as other ancillary services/programs.
Measuring Performance
One of the key measures for evaluating performance is the number of missed collections per
1,000 households on a monthly basis (Tables 1, 2 and 3), with an established goal of 1 or less.
This metric is tracked by line of service (Garbage, Recycling, Yard, and Bulk) as well as a total
number. As shown in the Tables, staff has worked with both contractors to improve results and
lower the number of misses with the best performance year-to-date in February.
However, due to subcontractor staffing shortage and increased turnover, summer heat related
mechanical issues and unanticipated equipment shortages stemming from increased non-
preventable, preventable and training related equipment damage, the subcontractor contractor
experienced a spike in misses over preceding four (4) summer months. Since implementing the
identified areas of improvement in late August and early September, Waste Management and its
subcontractor have demonstrated a significant improvement as shown in all Tables.
Service Level Improvement Plan
Based on staff's detailed evaluation, joint management meetings with both Waste Management
and its subcontractor, the Department will be adding additional reporting requirements and will
continue to pursue liquidated damages for nonperformance (penalties for non-performance).
While all solid waste collection systems deal with missed collections on a daily/weekly basis, the
current trend by the subcontractor involves incomplete service delivery which can impact 100's of
residents at a time (waste gets picked up a day late). Future contract discussions will include
stronger language and penalties to address this evolving issue.
