HomeMy WebLinkAboutOrdinance 6483 ORDINANCE NO. gf3 AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 2.403 SQUARE MILES, MORE OR LESS, OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA SHARE OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL OF THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 3rd day of May 1971, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 21st day of April , which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 390,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas was 212,5 square miles on January 1, 1971; and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth_, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 2.403 square miles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I . That the following described land and territory located approxi- mately 9 miles westerly of the Tarrant County Court House, lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: BEING a tract of land approximately 9 miles westerly of the Court House of Tarrant County, Texas, out of the following surveys in said Tarrant County: Jacob Wilcox No. 2 Abstract 1725, J.H. Smallwood Abstract 1485, R.W. Tannahill Abstract 1540, Socorro Farming Company Abstract 1837, G.W. Cathey Abstract 387, Garcia Montez & Duran Abstract 628, Socorro Farming Company Abstract 1840, J.W. Woods Abstract 1886, J.B. O'Dell Abstract 1189, S.B. Jamison Abstract 877, J.M. Steiner Abstract 1471 , W.C. Smith Abstract 1440, J.W. Haynes Abstract 795, and J.M. Rice Abstract 1799; and more fully described as follows: BEGINNING at a point in the west line of the.J. Armendaris Survey Abstract 61, 393 feet south of the NW corner of said survey, said point also being in the Fort Worth Corporate Boundary and in Silver Creek Road; Thence along said Corporate Boundary N 64021' W a distance of 454.2 feet, N 60002' W a distance of 319.4 feet, N 740Q2' W a distance of 144.4 feet, N 79030' W a distance of 168 feet, N 20058' W a distance of 738.8 feet, N 27014' W a distance of 702.7 feet, N 36929' W a distance of 444.4 feet, N 25015' W a distance of 138.8 feet, N 73017' W a distance of 313.8 feet, N 1017' W a distance of 79 1.1, to a point for corner, said point being in the south line of the north one-half of the Jacob Wilcox Survey Abstract 1725, and the SE corner of a school property; Thence north, west and south around said school tract to said south line of the north one-half of said Jacob Wilcox Survey 1725; Thence west along the south line of said north one-half of said Wilcox Survey, said south line also being the corporate boundary of Fort Worth, to the survey's west line; Thence south along the west line of said Wilcox Survey to a point for corner, said point being the SW corner of said Wilcox Survey and also in the north line of the J.H. Smallwood Survey Abstract 1485; Thence along the north line if said Smallwood Survey to a point for corner, said point being in the center of the.channel of a creek designated as Live Oak Creek; thence southwesterly with the meanderings of said Live Oak Creek, crossing the south line of said Smallwood Survey approximately 1000 feet east of its southwest corner, crossing the west line of the Socorro Company Survey Abstract 1837 approximately 700 feet south of its NW corner, crossing the south line of the G.W. Cathey Survey Abstract 387 approximately 400 feet east of -2- its southwest corner, crossing the east line of the J.M. Rice Survey Abstract 1799 approximately 1300 feet north of its most easterly SE corner; Thence continuing southwesterly with the meanderings of said creek to its intersection with the west line, produced north, of the J.M. Steiner Survey Abstract 1471; Thence south along said line produced north and along the west line of said survey to its SW corner; Thence east along the south line of said Steiner Survey to its intersection with the Fort Worth corporate boundary; Thence continuing east along said Fort Worth corporate boundary to the west line of the P. Caldwell Survey Abstract 365; Thence continuing with the Fort Worth corporate boundary north along the west line of said Caldwell Survey, and west, north, and east along the south, west and north lines of the J. Rowland Survey Abstract 1355 to the most easterly SE corner of the J.B. O'Dell Survey Abstract 1159; Thence north with the Fort Worth corporate boundary along the east line of said O"Dell Survey, and the east line of the R.W. Tannahill Survey Abstract 1540, to the point of beginning; and containing 2.403 square miles M/L. SECTION 2. The foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. -3- SECTION 5 This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. May®r and Council Communication DATE REFERENCE SUBJECT: Annexation of 2.403 Square PAGE NUMBER Miles Southwest of Lake Worth 4/19/71 PZ-439 1 1 of lhll8ldQiQp1 r The City Plan Commission at its meeting on March 24, 1971, recommended that the City of Fort Worth annex 2.403 square miles of land lying southwest of Lake Worth as shown on the attached map. Development in Subject Area In the portion of this area known as "Tejas Trails", residential development has been occurring since about 1964 with no subdivision plat control. Article 970a of the Revised Civil Statutes of Texas gives cities the size of Fort Worth, the authority to control subdivision plats within a five mile radius of their corporate boundaries, which includes the Tejas Trails area. This jurisdiction does not extend to zoning, building codes and utility in- stallations. This provision of the law is being circumvented by selling the property by metes-and-bounds descriptions without platting. Development has accelerated in recent months with several new streets and homes being constructed. At present, there are approximately 32 homes completed or in the process of being constructed. In addition, the same type of develop- ment is beginning to occur on other property in this area. With the construc- tion of I-820 in this area in the next four to six years , it is anticipated that development will accelerate. Utility Services for the Area A private company supplies water to the area and septic tanks are used for sewage disposal. Most of the streets are gravel and in need of maintenance. At a few points , the streets are hazardous and some of the grades are ex- cessive. The County refuses to maintain these streets and has placed a sign on White Settlement Road at the principal entrance to the area, to this effect. Extending Fort Worth services and utilities to the area will be costly. How- ever, the Plan Commission recommends annexation at this time since further uncontrolled development will intensify the.. problems and increase the cost of correcting them. This development .could also have an adverse effect on nearby property located in Fort Worth, and could encourage similar development in other fringe areas of the City. Recommendation It is recommended that the City Council set May 3, 1971, as the date for a public hearing on the contemplated annexation and that the staff be instructed to place the required legal notices in the official newspaper.
