Home My WebLink AboutOrdinance 23454-10-2018 Ordinance No. 23454-10-2018 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE INTERGOVERNMENTAL CONTRIBUTION FUND IN THE AMOUNT OF $2,000,000.00, RECEIVABLE FROM NORTHWEST INDEPENDENT SCHOOL DISTRICT, FOR THE BLUE MOUND ROAD - US287 TO WILLOW PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Intergovernmental Contribution Fund in the amount of$2,000,000.00, receivable from Northwest Independent School District, for the Blue Mound Road—US287 to Willow project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a construction contract with McClendon Construction Co. Inc. in the amount of$7,215,420.75 for Blue Mound Road and Willow Springs Road; and 2. Authorize the execution of Amendment No. 1 to City Secretary Contract Number 46108 Interlocal Cooperation Agreement to provide that Northwest Independent School District will reimburse the City for costs in the amount not to exceed $2,000,000.00 for the construction of Willow Springs Road and Blue Mound Road; and 3. Adopt the attached Appropriation Ordinance increasing receipts and appropriations in the Intergovernmental Contribution Fund in the amount of$2,000,000.00, receivable from Northwest Independent School District for the construction of Blue Mound and Willow Springs Road. DISCUSSION: The 2018 Bond Program includes funding for roadway capacity improvements along Blue Mound Road and Willow Springs Road. The main purpose of this project is to provide for the increasing traffic volume associated with the new V.R. Eaton High School campus and extensive land development activity to the north and west of the school. The construction contract will be funded by the Street Improvements Fund, Transportation Impact Fee Fund, TPW Community Facility Agreement Fund, 2014 Bond Fund, 2018 Bond Fund (M&C G-19306) and partially by an existing Interlocal Agreement between the City of Fort Worth and Northwest Independent School District City Secretary Contract No. 46108 (M&C C-27011). This Amendment No.1 provides that Northwest ISD contribute $2,000,000.00 towards the construction of Blue Mound Road and Willow Springs Road. The funds from Northwest ISD will be received by the City after construction of the improvements are completed and accepted by all parties. Funds for this project are included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Logname: 20BLUE MOUND ROAD AND WILLOW SPRINGS ROAD CONSTRUCTION Page I of 2 Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-05-2018). Blue Mound Road and Willow Springs Road was advertised August 2, 2018 and August 9, 2018 in the Fort Worth Star-Telegram. On August 30, 2018, the following bids were received: Bid Results Contractor Total Bid McClendon Construction Co. Inc. $7,215,420.75 Tiseo Paving Co. $7,704,968.35 Jackson Construction, Ltd. $7,879,754.00 McMahon Contracting, LP $8,166,244.46 The project will begin in January 2019 and the project will be complete in June 2020. The PARD annual maintenance cost is $4,784.00. Funding for operations and maintenance will be allocated into the Park and Recreation Department's base budget beginning in FY 2020. M/WBE OFFICE— McClendon Construction Co. Inc. is in compliance with the City's BDE Ordinance by committing to 2% MBE participation and documenting good faith effort. McClendon Construction Co., Inc. identified several subcontracting and supplier opportunities. However, the firms contacted in the areas identified did not respond or did not submit the lowest bids. The City's MBE goal on this project is 25%. This project is located in COUNCIL DISTRICT 7. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the capital budget, as previously appropriated of the Street Improvements Fund, Transportation Impact Fee Fund, TPW Community Facility Agreement Fund, 2014 Bond Fund, 2018 Bond Fund and the Intergovernmental Contribution Fund.
