HomeMy WebLinkAboutResolution 4996-10-2018 A Resolution NO. 4996-10-2018 ADOPTING A REVISED SCHEDULE OF STANDARD FINES AND LATE FEES FOR VARIOUS PARKING OFFENSES WHEREAS, Section 10-26(a) of the Code of the City of Fort Worth, Texas (2015), as amended, ("City Code") provides that any person, firm, or corporation that violates any provision of the City Code related to the stopping, standing, or parking of vehicles shall be fined in an amount not exceeding Two Hundred Dollars ($200.00) for each offense; WHEREAS, Section 10-26(b) of the City Code provides that the City Council may by resolution adopt a schedule of standard fines for parking offenses, such standard fines to be the amount paid by persons who do not desire a hearing on the citation and wish to pay by mail or otherwise; WHEREAS, City Council has not adopted revisions to the standard fines for parking offenses since January 26, 2010; WHEREAS, staff has completed analysis of what other cities charge for fines and recommends setting the fine amounts as outlined in this resolution; WHEREAS, City Council adopted an ordinance amending Chapter 10 of the City Code to add Section 10-12 assessing a $5.00 court cost for all parking violations committed on or after October 1, 2015, to be deposited into the Child Safety Fund in accordance with Article 102.014 of the Texas Code of Criminal Procedure, and this court cost is added to the fine amounts outlined in this resolution; and WHEREAS, in the case of fines that are $119.99 or less, City Council sets the late fee at $25.00 to be assessed after 21 days, and for fines that are $120.00 or more, City Council sets the late fee at $50.00 to be assessed after 21 days; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. That a late fee of $25.00 for fines $119.99 or less and a late fee of $50.00 for fines $120.00 or more, as outlined above, be assessed after 21 days of the violation if the fine is not paid; 3. That the $5.00 court cost collected under Section 10-12 of the City Code shall be added to the parking fine, as outlined above; and 4.
