AMENDMENT
TO CITY SECRETARY CONTRACT NO. 50755
STORMWATER FACILITY MAINTENANCE AGREEMENT
This AMENDMENT TO CITY SECRETARY CONTRACT NO. 50755,
STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by
and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas,
acting herein by and through its duly authorized City Manager or duly designated Assistant City
Manager, hereinafter referred to as the "City", and Burleson Fields, LLC, herein referred to as
"Landowner", and the McPherson Village HOA, Inc., hereinafter referred to as "Association",
acting herein by and through their duly authorized representatives, David Shipman, Jr., Member
of Burleson Fields, LLC, and Brock Johnson, Director of McPherson Village HOA, Inc.,
hereinafter referred to as "Licensee".
RECITALS
WHEREAS, the City of Fort Worth ("City"), Burleson Fields, LLC ("Landowner"), and
McPherson Village HOA, Inc. ("Association") made and entered into City Secretary Contract No.
50755 (the "Agreement") to authorize the use of on -site stormwater management facilities (the
"Facility") to be constructed and maintained on a portion of Landowner's property; and
WHEREAS, the Agreement was recorded with the property records of the Tarrant County as
document No. D218106674 which is one and the same as City Secretary Contract 50755 .
WHEREAS, the Agreement contains exhibit(s) "A" and "B" that depicts the location and
design specifications of the Facility; and
WHEREAS, it advisable to execute this Amendment to the Agreement to revise exhibit(s)
"A" and "B" in the Agreement to depict location changes and design changes being added to the
original agreement; and
NOW THEREFORE, City, Landowner, and Association, acting herein by and through their
duly authorized representatives, enter into the following that amends the Agreement:

Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the
Agreement, consisting of a revised location description of the Facility.
2.
Exhibit B is hereby replaced with Exhibit B-1 attached hereto and incorporated herein to the
Agreement, consisting of revised design specifications of the Facility.
3.
This Amendment shall be filed with the City Secretary as an amendment to the Agreement
and also recorded among the land records of Tarrant County, Texas, and shall constitute a covenant
running with the land, and shall be binding on the Landowner, its administrators, executors, assigns,
heirs and any other successors in interests, including any property owners association.
4.
All other provisions of the Agreement which are not expressly amended herein shall remain
in full force and effect

BEING a 4.20 acre tract for Storm Water Facility Maintenance Agreement, situated in the JOHN KORTICKY SURVEY, Abstract No. 914, Tarrant County, Texas, being over,
under and across a portion of that certain tract of land described in deed to Burleson Fields, LLC, recorded in Instrument No. D216137216, County Clerk's Records, Tarrant
County, Texas, said Maintenance Agreement being more particularly described, as follows:
COMMENCING at the northeast corner of said Burleson Fields, LLC, tract, from which a 1/2" capped iron rod found in the east line of Chisholm Trail Parkwy, at the northwest
corner of said Burleson Fields, LLC, tract, bears S 89'31'10" W, a distance of 1587.30 feet for reference and a 1/2" capped iron rod set stamped T.F. Stark RPLS 5084 at the
southeast corner of said Burleson Fields, LLC, tract, bears S 01 °45'36" E, a distance of 1981.55 feet for reference;
THENCE S 58°13'20" W, a distance of 57.75 feet to a point for the POINT OF BEGINNING, in the proposed west line of Summer Creek Road, at the most easterly northeast
corner of the herein described Storm Water Facility Maintenance Agreement tract;
THENCE S 01 °45'36" E, along the west line of said proposed Summer Creek Road, a distance of 500.00 feet to a point;
THENCE S 891110" W, leaving the proposed west line of said Summer Creek Road, a distance of 371.39 feet to a point in the proposed east line of Portadown Lane for the
southwest corner of the herein described Storm Water Facility Maintenance Agreement tract;
THENCE N 00°28'50" W, along the east line of said proposed Portadown Lane, a distance of 324.88 feet to a point at the beginning of a curve to the left, whose radius is 50.00
feet and whose long chord bears N 25°15'17" E, a chord distance of 46.01 feet;
THENCE continuing along the east line of said proposed Portadown Lane and along said curve, in a northeasterly direction, through a central angle of 54°47'22", an arc
distance of 47.81 feet to a point at the end of said curve;
THENCE N 00°28'20" W, leaving the east line of said proposed Porfadown Lane, a distance of 143.55 feet to a point in the proposed south line of Sunflower Ridge Road;
THENCE N 891110" E, along the proposed south line of said Sunflower Ridge Road, a distance of 330.00 feet to a point;
THENCE S 46'07'16" E, continuing along the proposed south line of said Sunflower Ridge Road, a distance of 14.30 feet to the POINT OF BEGINNING and containing 4,20
acres (182,951 square feet) of land, more or less.
