A Resolution
WHEREAS, the City Council of the City of Fort Worth,
Texas, consists of nine members, one of whom is the Mayor
' who is elected from the City at large and eight of whom are
Councilmembers who are elected from single-member districts,
and
WHEREAS, the office of
the City Council of the City
vacant because of the death of
on March 15, 1986, and
Councilmember, District 7, on
of Fort Worth, Texas, is now
the Honorable Richard C. Newkirk
WHEREAS, Chapter III, Section 4 of the Charter of the
City of Fort Worth and Section 201.052 of the Texas Election
Code provide that a special election to fill a vacancy shall
be held on the first authorized uniform election date occurring
on or after the thirtieth day after the date the election
is ordered, and
WHEREAS, Section 41.001(a) of the Texas Election Code
establishes the second Saturday in August (August 9, 1986)
as the nearest uniform date on which the City of Fort Worth
--could hold a special election, and

WHEREAS, Sections 41.001(b)(9) and 201.053 of the Texas
Election Code authorize the authority of a political subdi-
vision to hold a special emergency election to fill a vacancy
on a non-uniform date if the Governor of Texas determines
that an emergency exists and grants permission to order an
election on a non-uniform date,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS.
1 That the City Council hereby finds and determines
that the vacancy in the office of Councilmember,
District 7, constitutes an emergency, the nature
of which emergency is identified as follows
f
(a) that the voters of District 7 do not have a
Councilmember who is elected from their District,
(b) that the City Council consists of eight members
and a tie vote could occur without a procedure
for breaking the tier,

(c) :that the City Council is about to begin hearings
on the City budget and tax rate for 1986-1987
and the Councilmember representing District 7
should participate in such hearings,
(d) that the City Council is about to expend bond
funds for capital improvements and the Council-
member representing District 7 should participate
in the decision concerning how such funds will
be spent, and
(e) that the City Council has several committees
which are comprised of Councilmembers and meet
on a regular basis, and the Councilmember repre-
senting District 7 should serve on such
committees and attend the committee meetings
2. That the City Council desires to order that a special
emergency election be held on June 28, 1986, to
fill the unexpired term in the office of Council-
member, District 7, on the City Council of the City
of Fort Worth, Texas, as permitted under
Section 201.053 of the Texas Election Code.
3. That the City Council hereby respectfully asks that
The Honorable Mark White, Governor of Texas, determine
that an emergency exists and grant permission for
the City Council to order that an election be held
on June 28, 1986, a non-uniform election date.
4. That the Mayor is hereby authorized to forward a
copy of this Resolution to The Honorable Mark White.
