A ResoZution
WHEREAS, the City Council of the City of Fort Worth, Texas, con-
sists of nine members, one of whom is the Mayor who is
elected from the City at large, and eight of whom are
Councilmembers who are elected from single-member dis-
tricts; and
WHEREAS, Councilmember Kathy Wetherby has submitted to the City
Council her letter of resignation, whereby she is
resigning from the office of Councilmember, District 6,
effective upon the election of her successor; and _
WHEREAS, because of health reasons which she has cited as the basis
of her resignation, it is necessary that the City Council
hold an election as soon as possible to select her suc-
cessor so that Councilmember Wetherby may be relieved of
the duties of her office; and
WHEREAS, Chapter III, Section 4 of the Charter of the City of Fort
Worth, and Section 201.052 of the Texas Election Code pro-
vide that a special election to fill a vacancy shall be
held on the first authorized uniform election date occur-
ring on or after the thirtieth day after the date the
election is ordered; and
WHEREAS, Section 41.001(a) of the Texas Election Code establishes
the second Saturday in August (August 9, 1986) as the
nearest uniform date on which the City of Fort Worth could
hold a special election; and
WHEREAS, Sections 41.001(b)(9) and 201.053 of the Texas Election
Code authorize the authority of a political subdivision to
hold a special emergency election to fill a vacancy on a
non-uniform date if the Governor of Texas determines that
an emergency exists and grants permission to order an
election on a non-uniform date;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
1. That Resolution No. 1141, as adopted by the City Council on
April 8, 1986, is hereby repealed and of no further force and
effect. '

?2. That the City Council reluctantly and with great disappoint-
ment, accepts the resignation of Kathy Wetherby from the office
of Councilmember, District 6, effective upon the election and
qualification of her successor.
3. That the City Council hereby finds and determines that an
emergency warrants holding a special election for the office of
Councilmember, District 6, before the next uniform election
date so that Councilmember Wetherby may be relieved of her
duties of office as soon as possible.
4. That the City Council desires to order that a special emergency
election be held on July , 1986, to complete the unexpired
term in the office of Councilmember, District 6, on the City
Council of the City of Fort Worth, Texas, as permitted under
Section 201.053 of the Texas Election Code.
5. That the City Council hereby respectfully asks that The
Honorable Mark White, Governor of Texas, determine that an
emergency exists and grant permission for the City Council to
order that an election for Councilmember, District 6, be held
on July _, 1986, a non-uniform election date.
6. That the Mayor is hereby authorized to forward a copy of this
Resolution to The Honorable Mark White.
