(Developer) entered into Community Facilities Agreement, City Secretary Contract No. 33664, authorized by City Council on the 15th day of November, 2005 via M&C C-21159 (CFA); and WHEREAS, it has become necessary to increase the City's participation to the original contract by $4,865 due to the re-allocation of funds; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to increase City participation by $6,486 and Developer participation for costs associated with additional work not contemplated by the CFA. NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. Section II. DISCUSSION: On September 15, 1998, (M&C C-16994) the City Council authorized the execution of a developer's agreement to provide adequate water around the Alliance Airport area including areas to the west of Alliance Airport. On December 11, 2001, (M&C C-18878) the City Council authorized the execution of a Development Agreement for Sendera Ranch, which provided for the construction of a 36 inch water main to the proposed Sendera Ranch development for water service. On November 15, 2005, (M&C C-21159) the City Council authorized the execution of a Community Facilities Agreement for the design of the Sendera Ranch Pump Station and Ground Storage Tank, the Northside 1142 inch approach water main and the Northside III water main to serve Sendera Ranch and Sendera Ranch East, located in far north Fort Worth. Amendment No. 1 to the Engineering Contract (total $23,100.00) included additional costs for plan revisions and project coordination. The City's participation for Amendment No. 1 is calculated as $6,486.00 of the $23,100.00. In addition to Amendment No. 1, the City is allocating $4,865.00 to meet its obligation under the original contract. The total design cost for City Secretary Contract No. 33664 is increased by $11,351.00, which increases the total contract cost to $1,602,943.00.
