HomeMy WebLinkAboutResolution 1177J O I N T R E S O L U T I O N • WHEREAS the City of Fort Worth, a Texas municipal corporation, has established and operates an Office of Emergency ( Management, according to the laws of the State of Texas; and WHEREAS, the purpose of the Office of Emergency Management is to develop and administer a comprehensive program of emergency management which includes the rLLitigation, prepared- ness, response and recovery phases of an emergency or disaster situation which occurs within its jurisdiction; and WHEREAS, Tarrant County, a duly constituted political subdivision of the State of Texas, has in the past participated with the City of Fort Worth in the area of emergency prepared- ness; and WHEREAS, the City and County find that the common goal of adequate emergency preparedness for the benefit of the citizens of the City of Fort Worth and the citizens of the unin- corporated areas of Tarrant County can best be achieved through continuation of this joint relationship; and WHEREAS, the contemplated action is specifically authorized by City M & C No and Commissioners' Court Order 57271* and THEREFORE, BE IT RESOLVED that there is hereby established the Fort Worth Tarrant County Interjurisdictional Emergency Management Plan under the control of the Fort Worth Office of Emergency Management, according to terms which are mutually acceptable to both parties. • BE IT FURTHER RESOLVED that other municipalities may contract to join in the Interjurisdictional Emergency Management Plan, according to terms which are mutually acceptable to the City of Fort Worth and the subject municipality. BE IT FURTHER RESOLVED that this resolution abrogates and supersedes the resolution of the Commissioners' Court #30529 entitled,. RECOGNITION OF OFFICE OF CIVIL DEFENSE AS COORDINATING OFFICE OF EY'.ERGENCY GOVERNMENT OPERATIONS IN CIVIL DEFENSE EMERGENCY, and dated October 16, 1958, and the mutual aid agreements between the cities and municipalities of Tarrant County resulting from the above cited resolution and also dated October 16, 1958. " OLVED this yor, City of Fort Wo *40royed 8/18/86 1986. ounty Judge, r f V_1011 - 9 ounty STATE OF TEXAS § COUNTY OF TARRAA'T This agreement is entered into this day of 1986 by and between the City of Fort Worth, Texas ("City"), acting by and through its duly authorized City Manager, Douglas Harman, and Tarrant County, Texas ("County"), acting by and through its duly authorized County Judge, Mike Moncrief. W I T N E S S E T H: 'WHEREAS, the City of Fort Worth has developed an Emergency Management Plan pursuant to the Texas Disaster Act of - 1975, Texas Revised Civil Statutes, Art. 6889-8 (the "Act"); and 'WHEREAS, the member jurisdictions have, by resolution of the governing bodies of each, agreed to become an interjurisdictional agency for emergency management and disaster relief planning according to the terms of said Act; and kWHEREAS, the City of Fort Worth and Tarrant County are responsible for emergency management and disaster relief planning and education within the corporate limits of Fort Viorth and in the unincorporated areas of the County, respectively; and WHEREAS, it is the desire of both parties to agree to the terms under which Fort Worth will provide services relative X11 to emergency management and disaster relief planning and education services to County. • 1 Fort Worth shall provide County the services relative to carrying out the Interjurisdictional Agency Emergency Management Plan and the emergency management and disaster relief planning activities, as specified in Exhibit "A" attached hereto and made a part of this agreement for all purposes. 2. As payment for services rendered under the terms of this agreement, the County shall pay the City out of current revenues available the sum equal to 17-1/3 percent of the approved budget for the Office of Emergency Management, with 33-2/3 percent provided by City funds and the remaining 410 percent provided by federal/state matching funds. Payment by the County of the above sum shall be made in four equal quarterly payments following receipt of a quarterly report submitted by the City specifying all activities and services delivered to County during the quarter. 3. This agreement shall remain in effect for one year from the date of its execution and shall be annually renewable. The City will prepare and submit to County a proposed budget as documentation of anticipated expenditures at least thirty (30) days prior to the expiration date of the contract. AP Is 2 4. This agreement may be terminated by either party upon ,j ninety (90) days' written notice by one party to the other. 5. C? Each jurisdiction waives all claims against the other for property damage, personal injury or death occurring as a consequence of the performance of this agreement. 6. It is expressly understood and agreed that, in the execution of this agreement, neither jurisdiction waives, nor shall hereby be deemed to wain=e, any immunity or defense that would otherwise be available to it against claims arising during the exercise of governmental powers and unctions. Rev. Civ. Stat. Ann., Art. 6889-7, as amended, under the terms of Joint Tarrant County-City of Fort Worth Resolution dated 1. Present outreach programs on emergency preparedness subjects, upon request, and subject to available resources, to civic groups, fraternal organizations, clubs, schools, industrial emplovees, etc., throughout the county. 2. Conduct tornado safety inspections and act as consultants on emergency planning for county-owned facilities, schools, nursing/convalescent homes, hospitals, or for any organization, public or private, located in the county. . Coordinate floodplain management for adjacent to Fort Wo th it li i unincorporated areas r c y m ts with t he County Encineer, in cooperation with the Fort Worth Department of Transportation and Public Works. 4. Provide a city-county Emergency Operations Center for use as the control center for communications and management of local and/or widespread disaster throuahout Tarrant County. 5. Arrange and coordinate the development of legal contracts for intergovernmental and private sector resources for the mitia_a- tion, preparedness, response and recovery from disasters or mayor emergencies. 6. Coordinate, through the assistance of City of Fort Worth departments, special training sessions in emergency management activities. 7. Furnish reasonable quantities of available printed emergency management literature to citizens of the county, particularly items designed to educate them on the various aspects of emer- gency preparedness. B. Subject to proper authorization and availability, provide City of Fort Worth resources to assist in preparation for, response to, mitigation of and recovery from a disaster or major emer- gency. e 09. ., 00. Manage the Crisis Relocation Plan for the county and accomplish the required coordination with host county officials. Train and supervise amateur radio operators to serve as severe weather spotters and flash flood watchers throughout the county, mobilizing and coordinating their reporting activities during periods of severe weather. In addition, these volunteers will serve as emergency communications links throughout the county under emergency conditions. 11. Provide for dissemination of emergency information and warnings throughout the county by maintaining media hotline and emer- gency broadcast capabilities. 12. Maintain close liaison with Carswell Air Force Base officials to ensure timely assistance' from them in any county-wide dis- aster, as well as mutually coordinated responses to any off- base military aircraft crash within the county. 13. Coordinate with hospitals throughout the county on exercises to test their response according to the Fort Worth-Tarrant County Emergency Plan. maintain the procedural capability for preparing proper docu- mented requests for state and federal disaster declarations and appropriate assistance for transmittal by the County Judge when the magnitude of a disaster exceeds local capabilities for effecting relief and recovery. 15. Submit a quarterly report to the Commissioners Court outlining all activities involving services delivered to the counmty during the quarter. 16. Submit an annual budget to the Commissioners Court for review and documentation of expenditures anticipated for the coming year. 17. Any other activities required by law or deemed advisable in carrying out the lawful objectives of the Interjurisdictional Agency Emergency Management Plan. •
