HomeMy WebLinkAboutResolution 1199RESOLUTION NO WHEREAS. a petition containing the signatures of 12,258 people was presented to the Mayor Pro tempore of the City of Fort Worth, Texas, on December 15, 1986, requesting, to wit "We, the undersigned, registered voters of the City of Fort Worth do hereby petition the Fort Worth City Council to hold a Tax Rollback Election to roll back the tax rate adopted by the City Council on September 16, 1986 for the tax year commencing January 1, 1986 and ending December 31, 1986 to the maximum allowable under State Property Tax Code, Section 26 04, which is 8% (eight percent)", and, WHEREAS, an additional petition containing the signatures of 259 people was presented to the City Secretary of the City of Fort Worth, Texas, on December 17, 1986, and, WHEREAS, Ordinance No 9719 was adopted by the City Council of the City of Fort Worth, Texas, on September 16, 1986, providing for the levy and collection of an annual ad valorem tax on all properties situated within the territorial limits of the City of Fort Worth on the first day of January A.D , 1986, except such property as may be exempt from taxation by the Constitution and laws of the State of Texas; and, WHEREAS, Section 26.07 (b) of the Property Tax Code of the State of Texas states that a petition is valid, among other things, if it is signed by a number of qualified voters of the taxing unit equal to at least 10 percent of the number of qualified voters of the taxing unit according to the most recent official list of qualified voters not counting the signatures of voters gathered by a person who received compensation for .> circulating the petition and if it is submitted to the governing body on or rte. - before the 90th day after the date on which the governing body adopted the tax rate of the current year, and, WHEREAS, on December 15, 1986, there were 185,988 registered voters in the City of Fort Worth, of which 10 percent is 18,598, and, WHEREAS, the signatures of 12,258 people do not constitute 10 percent of the registered voters of the City of Fort Worth on December 15, 1986, and, WHEREAS, the submission of the petition containing the signatures of 259 people on December 17, 1986, exceeded the 90-day limit within which a petition may be presented requesting an election be held to determine whether or not to reduce the tax rate adopted by the current year NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS 1. That the petition submitted on December 15, 1986, requesting a tax rate rollback election hereby be declared invalid because the petition was not signed -by a number of qualified voters of the taxing unit equal to at least 10 percent of the number of qualified voters of the taxing unit according to the most recent official list of qualified voters, gBg 2.
