HomeMy WebLinkAboutOrdinance 23464-11-2018 Ordinance No. 23464-11-2018 AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 17154, CODIFIED AS CHAPTER 31 OF THE CODE OF THE CITY OF FORT WORTH, BY AMENDING ARTICLE VI, "SUBDIVISION DESIGN STANDARDS'; SECTION 31-106, "STREET DESIGN STANDARDS," SUBSECTION D, "STREET AND BLOCK FACE DESIGN STANDARDS (2) BLOCK FACE LENGTH TO ADD B.3 REGULATIONS FOR AREAS ZONED CR, C OR D. AND RENUMBER THE REMAINING SUBSECTIONS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 212 of the Texas Local Government Code allows municipalities to adopt rules governing plats and subdivisions of land within the municipality and the municipality's extraterritorial jurisdiction to promote the health, safety, morals, or general welfare of the municipality and the safe, orderly, and healthful development of the municipality; and WHEREAS, the City Council of the City of Fort Worth adopted the "Subdivision Ordinance" to promote orderly, safe and reasonable development of land within the city limits and extraterritorial jurisdiction ("ETJ"); and WHEREAS, the Plan Commission is authorized by the City Council to perform all duties and powers as provided by state statutes and the City Charter and Subdivision Ordinances and to adopt a set of rules of procedure in the course of those duties; and WHEREAS, City Council asked staff to identify design standards that would improve the quality of multifamily development, while considering cost impacts; and WHEREAS, it is recommended, that block lengths be addressed for areas zoned Low Density Multifamily"CR," Medium Density Multifamily"C"and High Density Multifamily"D"to ensure efficient circulation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS SECTION 1. Article VI, "Subdivision Design Standards"; Section 31-106, "Street Design Standards" of Chapter 31, "Subdivision Ordinance" of the City of Fort Worth, is hereby amended to add Subsection (d)(2)b.3, to include regulations for areas zoned Low Density Multifamily"CR," Medium Density Multifamily"C" or High Density Multifamily"D", to read as follows: Sec. 31-106 STREET DESIGN STANDARDS. (d) Street and Block Face Design Standards (2) Block face length. b.3. Regulations for areas zoned CR, C or D. Areas zoned for"CR" low density multifamily, "C" medium density multifamily, and "D" high density multifamily districts shall conform to the following block restrictions. To ensure efficient circulation, the maximum block face shall be 1,000 feet. Private streets with adjacent sidewalks that are accessible through a public use easement, or a private walkway, which is accessible through such public use easement, may serve as a block boundary. Walkways are required to connect to public streets for improved connectivity and walkability. Ch 31, Sec 31-106 amend Ordinance No.23464-11-2018 Pagel of 4 SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of provisions of the Code of the City of Fort Worth which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 5. Any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2000.00)for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 6. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two(2)days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. SECTION 7. This ordinance shall take effect upon adoption and publication as required by law. DISCUSSION: The City Council asked staff to identify design standards that would improve the quality of multifamily development, while considering cost impacts. Staff shared proposed standards with the Development Advisory Committee, the Real Estate Council of Greater Fort Worth, the Apartment Association of Tarrant County, the Zoning Commission and City Plan Commission. This M&C only applies to Subdivision Ordinance amendments. The proposed amendments would do the following: Require buildings to face streets, with parking, driveways and fencing between or behind buildings; Require street trees, enhanced landscaping and parking lot screening along public streets; Require 70% masonry and fagade variation; Require 250-foot setback from one- and two-family zoning to allow four- story multifamily in "D" multifamily zoning; Allow 36-foot top plate height for three-story buildings to allow higher quality units; Allow modest increase in units per acre given market demand for one-bedroom units: CR - 16 units/acre, C - 24 units/acre, D - 32 units/acre; and limit block lengths to 1,000 feet (UR and MU zoning are 500 feet) and require walkways to connect to public streets for improved connectivity and walkability. The amendments would not affect existing requirements for minimum yards, buffer yards and screening fences, open space, and off-street parking. Most of the proposed amendments are to the Zoning Ordinance (ZC-18-118), which will be heard by Zoning Commission on November 14th and by City Council on December 4th. The City Plan Commission heard the amendments related to the Subdivision Ordinance at the September 26th meeting. The Commission recommended approval to City Council for a text amendment to address multifamily block lengths. If approved, the Subdivision Ordinance, Article VI, Section 31-106 (d)(2)b, will include regulations for areas zoned CR, C or D as follows: Areas zoned for"CR" low density multifamily, "C" medium density multifamily, and "D" high density multifamily districts shall conform to the following block restrictions.
