HomeMy WebLinkAboutOrdinance 17356-01-2007Ordinance No.17356-01-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAl~ PROJECTS FUNp IN THE AMOUNT OF $149,500 FROM A TRANSFER FROM THE STORM WATER OPERATING FUND, FOR THE PURPOSE OF EXECUTING A CONTRACT AMENDMENT WITH DEOTTE, INC. TO PROVIDE ENGINEERING SERVICES FOR THE CITYWIDE ROADWAY FLOODING HAZARD ASSESSMENT; PROVIDING FOR A SEVERABILITY CiAUSIW; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $149,500 from a transfer frnrn the Storm Water Operating Fund, fnr the purpose of executing a contract amendment with DeOtte, Inc. to provide engineering services for the citywide roadway tioading hazard assessment. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void for any reason by a court of competent jurisdiction, such decision, opinion yr judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No, 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such a#her ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. ADOPTED AND EFFECTIVE: January 9, 2007 This ordinance shall take effect upon adoption. Authorize the transfer of $149,500.00 from the Storm Water Operating Fund to the Storm Water Capital Projects Fund, 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $149,500; and 3. Authorize the City Manager to execute amendment No. 1 to Engineering Agreement with DeOtte, Ina., to provide engineering services for the Citywide Roadway Flooding Hazard Assessment in the amount of $149,500 far a total contract cost of $312,500.00. DISCUSSION: In 2004, the Citywide Roadway Flooding Hazard Assessment was initiated to evaluate and prioritize roadway flooding hazards within the City and to prioritize them for removal, improvement, or installation of warning systems. On July 27, 2004, Council approved M&C C-20164 authorizing the City Manager to execute a contract with costs not to exceed $163,000 with DeOtte, Ina., far a Citywide Roadway Flooding Hazard Assessment. Of the 38 known hazardous lacations included in the original study, 14 lacatians have since had high water warning systems installed. Eight of the 38 locations are currently under design far roadway improvements to eliminate or significantly reduce roadway overtopping. Subsequent investigations have identified about 700 additional roadway locatoons which could be subject to flooding within the City. The flooding is known ar suspected to be hazardous at approximately 250 of these locations. DeOtte, Inc., submitted a contract amendment for $149,500, to evaluate and prioritize these 250 lacatians and to recommend warning systems or other treatments as appropriate at approximately 25 specific lacations. Staff considers this amount to be fair and reasonable for the proposed scope of work. This amendment No. 1 will be funded by the Storm Water Management Program, which was established to prevent flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a mare effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by improving infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. DeOtte, Inc., is in compliance with the City's MWBE Ordinance by committing to 15 percent MNVBE participation an this study.
