Authorize the transfer of$539,339.00 from the Water and Sewer Operating Fund to the Water Capital Project Fund in the amount of$349,612.00 and Sewer Capital Project Fund in the amount of$189,727.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of$349,612.00 and the Sewer Capital Project Fund in the amount of $189,727.00, from available funds; and 3. Authorize the City Manager to execute a contract with Stabile & Winn, Inc. in the amount of$1,172,455.00 for Pavement Reconstruction and Water and Sanitary Sewer Replacement on NW 25th Street from Macie Avenue to Mccandless Street and NW 26th Street from Robinson Street to Titus Street. DISCUSSION: On September 7, 2004, (M&C C-20258) the City Council authorized the City Manger to execute an engineering agreement with Freese & Nichols, Inc., for the design of NW 26th Street from Robinson to Titus Street and NW 25th Street from Macie Street to McCandless Street (DOE 4567), which consists of pavement reconstruction and water and sanitary sewer main replacement. The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on NW 26th Street from Robinson Street to Titus Street and NW 25th street from Macie Street to McCandless Street. Street improvements include pavement reconstruction, construction of standard concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. The project was advertised on June 23, 2005 and June 30, 2005. On July 21, 2005, the following bids were received: Bidders Amount(Alt. "A") Amount _(Alt. No Bid $1,173,462.20 JLB Contracting, L.P. $1,233,019.37 $1.273,578.87 Jackson Construction, Ltd. $1,367,466.75 $1,391,309.75 Time of Completion: 210 Calendar Days Bids were received on two alternates: . Alternate "A" consists of a 6-inch hot mix asphalt concrete (HMAC) over 8-inch lime stabilized subgrade with 7-inch concrete curb and 18-inch gutter . Alternate "B" consists of a 6-inch concrete over 6-inch lime stabilized subgrade with 7-inch concrete curb After reviewing all bid proposals, staff recommends Alternate "B" (concrete) for construction since the use of concrete will result in less maintenance cost over the street's useful life. Funding in the amount of $47,098.00 is included for associated water and sewer construction survey, project management, pre-construction, material testing, inspection and project close out (water $30,320.00 and sewer $16,778.00). The contingency funds to cover change orders total $23,440.00 (water $15,204.00 and sewer $8,236.00). Funding in the amount of $90,293.00 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. Contingency funds to cover change orders is $25,000.00. M/WBE - Stabile & Winn, Inc. is in compliance with the City's M/WBE Ordinance by committing to 6% M/WBE participation and documenting good faith effort. The City's goal on this project is 22%. This project is located in COUNCIL DISTRICT 2 Mapsco 47X,Y and 616,C. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Project Fund, the Sewer Capital Project Fund and the Street Improvement Fund. Whenever reference is made to standard specifications, regulations, requirements , statutes , etc. , such referred to documents shall become a part of the Contract Documents just as though they were embodied therein. C1-1. 23 WORKING DAY: A working day is defined as a calendar day, not including Saturdays, Sundays , and legal - holidays, i.n which the weather or other conditions not under the control .of the Contractor permit the performance of the principal unit of work for a period of not less than seven ( 7 ) hours between 7: 00 a.m. and 6 : 00 p.m. , with exceptions as permitted in paragraph C7'-7.6. C1-1. 24 CALENDAR DAYS : A calendar day is any day of the week or month, no days being excepted.
