INTERLOCAL AGREEMENT
BETWEEN THE CITIES OF ARLINGTON, FORT WORTH, HALTOM CITY, HURST, NORTH
RICHLAND HILLS,TEXAS AND COUNTY OF TARRANT,TEXAS
2006 BYRNE JUSTICE ASSISTANCE GRANT(JAG) PROGRAM AWARD
This Agreement is made and entered into this '%g day of February 2006, by and between The
COUNTY of TARRANT, acting by and through its duly authorized representative, hereinafter
referred to as COUNTY,the CITY of FORT WORTH, acting by and through its duly authorized
representative, hereinafter referred to as CITY, and the cities of Arlington, Haltom City, Hurst, and
North Richland Hills, acting by and through their duly authorized representatives, and hereinafter
referred to as SUBRECIPIENT, located entirely within the State of Texas, witnesseth:
WHEREAS, this Agreement is made under the authority of Section 791.011 of the Texas
Government Code; and
WHEREAS, each governing body, in performing governmental functions or in paying for the
performance of governmental functions hereunder, shall make that performance or those payments
from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the best
interests of all parties, that the undertaking will benefit the public, and that the division of costs
fairly compensates the performing party for the services or functions under this agreement; and
WHEREAS,the CITY has agreed to serve as the fiscal agent for the 2006 BYRNE JUSTICE
ASSISTANCE GRANT (JAG), and distribute all such funds between the cooperating parties; and
WHEREAS, the CITY agrees to provide the COUNTY$43,339 from the JAG award; SUBRECIPIENT
ARLINGTON aggress to provide the COUNTY with $22,638 from the JAG award, SUBRECIPIENT
HALTOM CITY agrees to provide the COUNTY$1,754 from the JAG award; SUBRECIPIENT HURST
agrees to provide the COUNTY$1,688 from the JAG award; and SUBRECIPIENT NORTH RICHLAND
HILLS agrees to provide the COUNTY$1,747 from the JAG award for the Prosecution and Court,
Drug treatment, and Prevention and Education Programs; and
WHEREAS, the CITY, SUBRECIPIENTS and COUNTY believe it to be in their best interests to
reallocate the JAG funds.
NOW THEREFORE,the COUNTY and CITY, and SUBRECIPIENTS agree as follows:
Section 1.
CITY agrees to pay COUNTY a total of$71,166 of JAG funds.
CITY agrees to pay SUBRECIPIENT ARLINGTON a total of$118,850 of JAG funds.
CITY agrees to pay SUBRECIPIENT HALTOM CITY a total of$9,211 of JAG funds.
CITY agrees to pay SUBRECIPIENT HURST a total of$8,865 of JAG funds.
CITY agrees to pay SUBRECIPIENT NORTH RICHLAND HILLS at total of$9,172

Section 2.
COUNTY agrees to use $71,166 for the Prosecution and Court; Drug Treatment; and Prevention and
Education Programs until September 30, 2009; and,
CITY agrees to use$227,530 for the Law Enforcement; Planning, Evaluation, and Technology
Improvement; and Prevention and Education Programs until September 30, 2009; and,
SUBRECIPIENT ARLINGTON agrees to use $118,850 for the Law Enforcement Program until
September 30, 2009; and,
SUBRECIPIENT HALTOM CITY agrees to use $9,211 for the Law Enforcement Program until
September 30, 2009; and,
SUBRECIPIENT HURST agrees to use$8,865 for the Planning, Evaluation, and Technology until
September 30, 2009; and,
SUBRECIPIENT NORTH RICHLAND HILLS agrees to use $9,172 for the Law Enforcement Program
until September 30, 2009.
Section 3.
Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY or
SUBRECIPIENTS other than claims for which liability may be imposed by the Texas Tort Claims Act.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims against CITY
other than claims for which liability may be imposed by the Texas Tort Claims Act.
Section 5.
Each party to this agreement will be responsible for its own actions in providing services under this
agreement and shall not be liable for any civil liability that may arise from the furnishing of the services
by the other party.
Section 6.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.
Section 7.
By entering into this Agreement, the parties do not intend to create any obligations express or
implied other than those set out herein;further, this Agreement shall not create any rights in any
party not a signatory hereto.
Section 8.
CITY shall provide reimbursement to COUNTY and SUBRECIPIENTS in a timely manner, not to
exceed 45 days, upon receipt of a written request for payment from the COUNTY or
SUBRECIPIENTS, not to exceed the amounts listed in Section 1 above.

Authorize Application for an Acceptance of FY2006 Byrne Justice Assistance Grant; Approve Inter-
Local Agreement with Tarrant County, Arlington, Hurst, Haltom City and North Richland Hills for the
City of Fort Worth to Serve as the Cognizant Fiscal Agency; and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Hold a public hearing to allow public comment to fulfill grant application requirements;
2. Apply for and accept, if awarded, the FY 2006 Byrne Justice Assistance Grant in the amount of
$444,794, for the period October 1, 2005 through September 30, 2009;
3. Approve an Inter-Local Agreement to have the City of Fort Worth to serve as the cognizant fiscal agency
on this grant for Tarrant County, Arlington, Haltom City, Hurst and North Richland Hills;
4. Authorize the use of anticipated interest in the amount of$10,000; and
5. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Grants Fund by $454,794.
DISCUSSION:
The United States Department of Justice has discontinued the Local Law Enforcement Block Grant
(LLEBG) program and replaced it by combining the Edward Byrne Memorial Fund, a discretionary grant
program and a new program to create the FY 2006 Byrne Memorial Justice Assistance Grant (JAG).
Under the LLEBG, the City of Fort Worth, along with several other jurisdictions, were deemed "disparate"
agencies and had to negotiate with Tarrant County to develop a program budget and strategy. Previously
each city applied for their own grant and contracted with Tarrant County to provide funds. This strategy is
not allowed in Justice Assistance Grants. All funds destined for agencies certified as disparate must be
pooled, a spending plan must be developed and one agency must serve as the cognizant jurisdiction to
apply for and disperse funds. A committee of all impacted law enforcement agencies developed an
application strategy and Fort Worth was selected to serve as the cognizant agency as it did for last year's
Justice Assistance Grant.
A total of $444,794 is available for all jurisdictions, with no matching funds required and will be distributed
in the following manner:

Fort Worth is responsible for submitting the full grant application and will distribute funding as agreed to
Tarrant County, Arlington, Haltom City, Hurst, and North Richland Hills. The initial funding period is
October 1, 2005 through September 30, 2009.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of
the Grants Fund.
