Council Member Williams introduced a resolution and made a motion that it be adopted. The motion was seconded by Council Member Zapata The resolution was read by the City Secretary The motion, carrying with it the adoption of said resolution, prevailed by the following vote AYES Mayor Pro tempore Stute, Council Members Zapata, Johnson, Lancaster, Williams, Wetherby, Newkirk, and Bagsby NOES None ABSENT Mayor Bolen Resolution No 1039 The resolution, as adopted, is as follows RESOLUTION NO 1039 WHEREAS, on June 12, 1974, the City of Fort Worth entered into an agreement with Lake Country Estates, Inc., wherein in authorized the formation of the Tarrant County Municipal Utility District No. 1, which agreement also established certain terms and conditions regarding the operation of said Tarrant County Municipal Utility District No. 1, and WHEREAS, according to the terms of the above referenced agreement, the Tarrant County Municipal Utility District No 1 must receive the consent of the City of Fort Worth in order to add land into the said District, which consent is to be evidenced in a resolution of the City Council of the City of Fort Worth, and WHEREAS, the Tarrant County Municipal Utility District No. 1 has received a request (copy attached as Exhibit "A") from the property owners of an area of land known as 'The Seville," to add that area described therein into the said District which area is in the extraterritorial jurisdiction of the City of Fort Worth, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS That the City Council of the City of Fort Worth hereby consents to the addition of the property known as The. Seville, more particularly described by metes and bounds in the request attached hereto and marked Exhibit "A", into the service area of the Tarrant county Municipal Utility District No. 1, subject to all of the conditions adopted by the City Council in its original approval of Tarrant County Municipal Utility District No. 1, dated June 12, 1974, and in City Secretary Contract Nos 9637 and 9638. Denied petition of request of John Wasilchak.for consent to form the Oak Grove municipal utility dist There was presented Mayor and Council Communication No. G-6258 from the Acting City Manager, as follows Mr John Wasilchak has petitioned for City of Fort Worth consent to form a municipal utility district to be known as the Oak Grove Municipal District (OGMUD) located just east of Village Oreek on Rendon Road (see attached petition and map) The general nature of the work to be accomplished with the OGMUD would be to construct and operate a water system, sewer system and drainage system in the 270 acre subject area Staff has reviewed this request in the context of recently formulated growth management strategies and urban development potential of the subject area. As discussed at the February 12, 1985 Pre-Council Session (I R No 6999), staff recommends that the City oppose creation of the OGMUD because (1) the area seems to be in a logical growth and utility extension area of Fort Worth, and (2) various trends such as the 500 acre Oak Grove Estates development, acquisition of the South Fort Worth Airport, etc., indicate the area will urbanize in the reasonable future Recommendation It is recommended that the City Council 1) Deny the petition or request of John Wasilchak for the City's consent to form the Oak Grove Municipal Utility District, 2) Authorize the City Manager to take action necessary to oppose creation of the Oak Grove Municipal Utility District, and, 3) Instruct the City Manager to work with the petitioner in exploring options such as annexation and extension of City water and sewer service. 11 . ::. TUESDAY, FEBRUARY 19, 1985 ? f BEGINNING at a point in the south line of said 50 0 acre tract, said point being north 89 degrees 31 minutes east 802 20 feet from the southwest corner of said 50 0 acre tract to an iron pin, THENCE north 14 degrees 30 minutes east a distance of 277 08 feet to an iron pin; THENCE along a curve to the right having a radius of 460 0 feet a long chord bearing north 48 degrees west 222.57 feet an arc distance of 224 80 feet to an iron pin, THENCE along a curve to the left having a radius of 400 feet a long chord bearing north 62 degrees west 375 58 feet an arc distance of 390 95 feet to an iron pin, THENCE west a distance of 150.0 feet to the Fort Worth City Limit Line; THENCE north along said Fort Worth City Limit Line 225 feet east of and parallel to the centerline of Cooks Lane a distance of 185 20 feet, THENCE south 13 degrees 18 minutes east a distance of 260 65 feet to an iron pin, THENCE south 28 degrees 47 minutes east a distance of 130 05 feet to an iron pin, THENCE south 24 degrees 45 minutes east a distance of 201 77 feet to an iron pin, THENCE south 89 degrees 31 minutes east a distance of 1122 80 feet i to the Point of BEGINNING and containing 20 3179 acres of land. i When the motion was put to a vote by the Mayor, it prevailed unanimously Wetherby resumed her ? j At this time Council Member Wetherby resumed her seat at the Council table seat There was presented Mayor and Council Communication No. G-6257 from the Adopted Resolution No Acting City Manager, as follows 1039 auth Tarrant Count Municipal Utility I Background 1974 (M&C G-2347), the City Council authorized the Tn--Ju-ne--T7 District No 1 to add t8 the district the propert , y creation of the Tarrant County Municipal Utility District No 1 known as The Seville I (District), by accepting the petition of the property owners for the creation of that entity, in the City's extraterritorial jurisdiction (ETJ) in the area of Eagle Mountain Lake, generally known as Lake County Estates At that time, the creators of the District entered into an agreement with the City, which, among other items, specifies that property within the City's ETJ can not be annexed into the District without the approval by the City Council of a resolution authorizing the annexation Subsequently on December 27, 1977, the City and the District entered into contracts whereby the City now provides water and sanitary sewer service to the District (City Secretary Contract No. 9637 and City Secretary 9638, respectively ) The creation of the District and the two contractual agreements also grants to the City f necessary controls to insure that utility development in the District will meet acceptable standards The District has received recently, a petition from the owners of the property called 'The Seville" (copy attached), requesting annexation into the District. The property is located northwest of the District's area and is on the shore line of Eagle Mountain Lake between Houston Hill and Lichner south of Boat Club Road A metes and bounds description of the subject property is contained in the petitioner's request The area is in the City's ETJ Water and sewer utilities are remote from the Fort Worth system, and the area can presently be served more efficiently by the District The annexation will allow the District to provide utility service to this area and to further protect the water supply in Eagle Mountain Lake which serves the Fort Worth area Preliminary Plat P-84-67, THE SEVILLE, describes the area in the request along with the same description in the petition request to the District The preliminary plat is on file and has been approved by the City Plan Commission Recommendation It is recommended that the City Council adopt the attached resolution authorizing the Tarrant County Municipal Utility District No. 1 (Lake Country Estates) to add to the District the property known as 'The Seville" It is further recommended that approval be subject to all of the conditions adopted by the City Council in its original approval of the Tarrant County Municipal Utility District No. 1, on June 12, 1974, and in City Secretary Contract Nos 9637 and 9638.
