AMENDMENT No. 1

COUNTY OF TARRANT
WHEREAS, the City of Fort Worth (City) and Kimley-Horn and Associates, Inc.,
(Engineer) made and entered into City Secretary Contract No. 30444, (the Contract) which was
authorized by the City Council by M&C 20237 on the 24th day of August, 2004; and
WHEREAS, the Contract involves engineering services for the following project:
Eagle Mountain Raw Water Transmission Pipeline
WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to
include an amended scope of work, with no change to the maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the Contract:
1.
Article I of the Contract is amended to delete certain items of work and to add
those additional engineering services specified in the proposal letter dated August 29,
2005, a copy of which is attached hereto and incorporated herein. There is no net charge
to the contract amount associated with this change in the scope of work.
All other provisions of the Contract which are not expressly amended herein shall remain
in full force and effect.

Amendment #1-Additional Services - Survey and Easement Acquisition

Dear Chris:
As we have discussed with you, as part of this project, there have been a few
requests for Kimley-Horn to provide services for items that were not
specifically part of the original scope of services for this contract. Most of the
requests have been related to easement acquisition along the pipeline alignment,
all of which have involved two of Kimley-Horn's subconsultants: James
Daniels & Associates, Inc. and SAM, Inc. The following is a summary of the
additional services performed and the amount requested:
Additional Survey and Survey Coordination
The original scope of services called for locating trees twelve -inch diameter and
larger within the limits of the survey. Per the City's request, the revised
topographic survey included locating trees 4-inch diameter and larger. In
addition, additional meetings were requested by the City to meet with the
property owner for coordination of right -of -entry, boundary, and topographical
survey.
The additional amount requested for these services is $5,500.00.
Revised Appraisals
As part of negotiations with property owners, the City requested that the
appraisals for Parcels 1, 2, 3, 4A, and 4B (Rosen and Geren parcels) be revised
to include any possible damages to the remainder tracts.
The additional amount requested for these services is $5,000.00.

Proposed Centerline Staking
As a result of conversations between you and Mr. Harry Brants regarding
easement acquisition, it is our understanding that Mr. Brants requested that the
centerline location of the proposed 72-inch pipeline be staked on his property.
After meeting with Mr. Brants, the City requested that the pipeline centerline
be staked along its proposed alignment at 200 foot intervals and at all points of
intersection.
The additional amount requested for these services is $3,927.00.
Subsurface Utilitv Engineering (SUE)
Due to the number of points of intersection along the existing 54-inch raw
water pipeline on the Brants property, Kimley-Horn has been unable to
determine the exact location of the line with traditional survey methods. The
location of approximately 3,100 LF of 54-inch line is unconfirmed due to the
lack of above ground appurtenances between these points. On the north end of
the Brants property the line is also outside of its easement. Additionally, there
is a significant portion of the 54-inch line along Robertson Road that is located
outside of its easement.
Due to the varying location of the existing 54-inch water line in other areas that
do not appear to be consistent with the record drawings, Kimley-Horn would
recommend that the City consider utilizing SUE services to assist in locating
this line. These services consist of providing Quality Level B designating
services through the use of geophysical prospecting techniques.
The additional amount requested for these services is $6,588.00.
Based upon our original contract with the City, it appears that there will be
approximately $40,000 of unused fee that was originally allocated for our
tunneling subconsultant, Dr. G. Sauer Corporation. If the City concurs with our
requested additional services, we recommend that a portion of this unused fee be
reallocated to increase the original budgets for surveying and easement
acquisition services. This will result in no increase to our total contract amount
of $799,855.
A fee summary of the services explained above is shown on the following table.
Also included is a 10% markup for the additional subconsultant services
performed by SAM, Inc. The additional subconsultant services performed by
James Daniels & Associates, Inc. will not be marked up per the original contract
language. The fee table shows a total reallocation request of $22,720.

All of these services will be performed by M/WBE subconsultants. This will
revise our total contract M/WBE participation percentage to be 24.7 % . Our
M/WBE goal for this project is 22.0%.
