Subject: Notice of Establishment of a Railroad Quiet Zone under 49 CFR
222.39(x)(1)Quiet Zone: BNSF E 1st Street
In order to activate the quiet zone described herein pursuant to the requirements of 49
CFR 222 et. seq., the City of Fort Worth submits this Notice of Quiet Zone Establishment
inclusive of Attachments"A—D".
Crossings contained in the Quiet Zone
This is an extension of the existing BNSF&E. 1't Street Quiet Zone. All public highway-
rail grade crossings to be included within the quiet zone are as follows:

Effective Date of Quiet Zone
August 9, 2006 is the date upon which routine locomotive hom use at the above crossings
shall cease.
Regulatory basis for designation of Quiet Zone
This Quiet Zone will be established under the regulatory provisions of 49 CFR 222.39(a),
which require implementation of Supplemental Safety Measures at every public crossing
in the Quiet Zone.
Prior to the effective date, the following equipment will be in operation:
Peach Street: Existing two-quadrant gate system includes constant warning
system, power-out indicators and a median barrier. This installation will comply
with the requirements of Appendix A to Part 222 A.3 Gates with Medians or
Channelization Devices.
Time period within which restrictions on the horn will be imposed
The time period within which restrictions on the hom will be imposed is 24 hours per
day.

Notice of Intent
A Notice of Intent to Establish a Quiet Zone at the above listed locations was mailed to
all railroads operating over the public grade crossings within the proposed quiet zone,the
State agency responsible for grade crossing safety, and the State agency responsible for
highway and road safety for those crossings on March 23, 2006, by certified mail,return
receipt requested.
The Notice of Intent was mailed more than 60 days before the mailing of this Notice of
Quiet Zone Establishment. Written comments were received from Texas Department of
Transportation and Amtrak. BNSF Railway did not respond within the 60 day period.

Authorization to Execute a Notice of Quiet Zone Establishment to Extend the Quiet Zone at the
BNSF Railway Railroad Crossing at East First Street to Include East Peach Street
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to sign a Notice of Quiet Zone
Establishment for the extension of the East First Street quiet zone at the BNSF Railway railroad crossing to
include the East Peach Street crossing.
DISCUSSION:
The Transportation and Public Works Department proposes to extend a quiet zone under the recently
published Federal Railroad Administration (FRA) Train Horn Rule. With the approval of this M&C and the
recent completion of the railroad crossing installation upgrade at East Peach Street, the quiet zone will be
effective on July 24, 2006 or soon thereafter.
With the authorization to extend this quiet zone, the city will be prohibiting the routine sounding of the
locomotive horns at East Peach Street railroad crossing located on the BNSF Railway. This project is
totally funded by Trinity Bluff Development, Ltd., under a Community Facility Agreement and reimbursable
through a Tax Increment Financing Agreement. No city funds are required for the construction of this
project.
The FRA's Train Horn Rule provides procedures that the city can follow to create quiet zones that would
prohibit routine train horn use. The city must install supplemental safety measures (SSMs) to compensate
for the train horn. With a proper SSM, or quiet zone device in place, the city can issue a Notice of Quiet
Zone Establishment to inform the FRA, the railroad and others that the crossing is in conformance with the
federal standards for a quiet zone. Federal approval is not necessary; however, strict guidelines are
established to certify that each crossing is in conformance with FRA standards. The Train Horn Rule
became effective June 24, 2005 and is established as federal law under 49 CFR Parts 222 and 229 Use of
Locomotive Horns at Highway-Rail Grade Crossings.
The new quiet zone is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds at this time.
