The Texas Commission on Environmental Quality (TCEQ), and the City of Fort Worth hereby
agree to amend Contract No. 582-5-55879, as shown below. This amendment will extend the
contract period, and increase the contract amount.
1, TCEQ and the City of Fort Worth agree that the total compensation possible under this
contract is as follows:
The Original Contract Amount $347,200.00
Contract Amendment No. 1 $ 0.00
Contract Amendment No. 2 $173,600.00
Contract Amendment No. 3 $ 55,500.00
The Total Contract Amount $576,300.00
2. Article 4 of the Agreement (relating to Term of Contract) is amended to reflect the
following revisions.

This Contract shall begin on 9/22 , 2004, or date of last contract signature, whichever is
later, and shall terminate on full performance, which is due on 08/31, 20 06 , unless
terminated early or extended in accordance with the terms of the Contract.
3. Article 6, Item 2 of the Agreement (relating to the Project Representative Sheet) is
amended to reflect the changes shown on Attachment A. This change will reflect a new
project representative for the TCEQ.

All other conditions and requirements of Contract Number 582-5-55879 will remain unchanged.
This Amendment will be effective upon 7/1/06 or the date of the last contract signature, whichever

Authorize Execution of Amendment No. Three to City Secretary Contract No. 30629 with the Texas
Commission on Environmental Quality for the Operation of Local Air Pollution Monitors and Adopt
Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute Amendment No. Three to City Secretary Contract No. 30629 with
the Texas Commission on Environmental Quality (TCEQ) extending the contract time through August 31,
2006 and increasing the not to exceed amount from $520,800 to $576,300; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $55,500 in FY 2005-06, subject to a receipt of an executed amendment.
DISCUSSION:
In 2003 the United States Environmental Protection Agency launched a new air monitoring network. The
Texas Commission on Environmental Quality has been designated as the administering agency. Since the
inception of the new monitoring program, the TCEQ has contracted with the City for operation and
maintenance of the monitoring equipment.
The Department of Environmental Management will operate and maintain nine whole-air samplers in the
Fort Worth area. The City will collect air monitoring samples, send samples daily to designated analytical
laboratory and perform various maintenance activities on the equipment under the terms of the agreement.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of
the Grants Fund.
