HomeMy WebLinkAboutResolution 1052 A RJaSOIu OZa Adopted Ordinance No? i WHEREAS, the Director of the Department of Public Health of the City of Fort Worth has reported to the City Council that Thomas Steel Drums, Inc., operates a steel drum cleaning facility at 2517 N.E. 35th Street, Fort Worth, Texas, and has committed, is committing and threatens to commit violations of the Texas Clean Air Act, the City of Fort Worth Air Pollution Ordinance and Rules of the Texas Air Control Board, which violations are within the jurisdiction of the City of Fort Worth; and WHEREAS, on May 1, 1984, the City Council adopted Resolution No. 985 authorizing litigation against Thomas Steel Drums, Inc.; and WHEREAS, due to a clerical error, the street address of Thomas Steel Drums,, Inc., was incorrectly stated in such Resolution as 2517 N.W. 35th Street; and WHEREAS, the City Council desires to amend such resolution to reflect the correct address, 2517 N.E. 35th Street, and to confirm and bring forward its previous authorization expressed therein for a lawsuit for injunctive relief, civil penalties and other relief by the City of Fort Worth through its attorney against Thomas Steel Drums, Inc.; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. That the above described amendment is hereby effected; 2. That the City Attorney is authorized to continue to pursue liti- gation in District Court against Thomas Steel Drums, Inc., for injunc- tion, civil penalties and other relief, as au thorized by Section 4.03 and Subsection (a) of Section 4.02 of the Texa s Clean Air Act, and for enforcement of provisions of the Air Pollution Ordinance of the City of Fort Worth, with the Texas Air Control Board as a party thereto.
