HomeMy WebLinkAboutContract 33785 CITY SECRETARY ' I- Irl-CONTRACT NO. �ALJ In- AGREEMENT This Agreement is entered into as of the day ofV , 2006, by Town Center Mall, L.P. (Town Center Mall) and the City of Fort Wort (City), a home rule municipal corporation, acting by and through its duly authorized Assistant City Manager. WHEREAS, Town Center Mall and City have entered into a five year lease agreement ("Lease") (City Secretary Contract Number 33451 & M&C C-21395) for office space located in La Gran Plaza Tower, 4200 South Freeway, Fort Worth Texas("Property"); and WHEREAS, in order for the city to fully utilize the office space, it is necessary to install computer conduits on the Property in locations shown on the attached Exhibit"A"; and WHEREAS, City has requested that Town Center Mall allow the installation of the conduits on the building and through the building in exchange for the City assuming responsibility that the work will be conducted in a good and workman like fashion and that the City will be responsible for any damage caused as a result of the conduit installation. NOW THEREFORE, in consideration of the mutual covenants and promises contained herein, Town Center Mall and the City agree as follows: 1. Town Center Mall agrees to allow City to install conduits in the approximate location shown on the attached Exhibit "A." Such installation work is more particulary described in Exhibit`B". 2. City shall install the conduits at its sole cost and expense and subject to the terms contained in this Agreement. 3. City shall ensure that the installation will be performed in a good and workman like manner by a contractor who is knowledgeable and experienced in the installation of conduits. 4. City agrees to minimize any damage to the Property caused as a result of the installation. 5. City shall be responsible for any damage to the Property resulting from the installation work described in Exhibit"B". 6. City agrees that it will not cause or permit any mechanics' liens or other liens to be filed against the Property by reason of any work, labor, services, or materials supplied or claimed to have been supplied to City for the installation of the conduit. If such a mechanic's lien or materialman's lien is recorded against the Property as a result of the installation, City shall cause it to be removed. 7. This Agreement shall terminate upon the termination of the Lease 8. If any action, whether real or asserted, at law or in equity, arises on the basis of any provision of this Agreement, venue for such action shall lie in state courts located in Tarrant County, Texas or the United States District Court for EEO no 1 •.:�r.rnr ;- Northern District of Texas – Fort Worth Division. The pipe will be strapped to the siding using Bridgeport two hole straps. Sheet metal screws will be used to secure them to the metal. Contractor will place silicon between the strap and the metal to help prevent any moisture from getting through. Along the concreter portion of the run %" nail anchors will be used to secure the pipe. The pipe will be connected together with a 1" rigid coupler where any two pieces mate together. Every 100 feet or two 90 degree bends there will be placed a C100 (inline LB) for pulling. A right angle LB connector will be used to turn into the building at each end of the run. At each end of the run just inside the building a compression end connector will be placed to terminate the run. Contrator will be drilling a 1-1/8" or 1-1/4" hole to penetrate the building on the east end of the run. It will be as small as possible to get the tightest fit. Once the pipe has been installed, the hole will be sealed from both sides with silicon to prevent any moisture form entering the building. At the west end of the run the pipe will be entering into a mechanical room. Contractor will enter the same way as everything else. The rest of the conduits entering simply enter through the vents. Blades have been knocked out of the way to make room as needed. The only way to seal this would be to use an expanding foam once the pipe has been installed. 3 NTY M12°1MAa"117 FT, ra J%M i
