HomeMy WebLinkAboutOrdinance 19500-01-2011Ordinance No. 19500-01-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL PROTECTION PROJECT FUND IN THE AMOUNT OF $400,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING ENVIRONMENTAL AND ENGINEERING CONSULTING SERVICES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Protection Project Fund in the amount of $400,000.00, from available funds, for the purpose of funding environmental and engineering consulting services. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Approve the transfer of $400,000.00 from the Environmental Services Operating Fund (R103) to the TPW-Environmental Protection Project Fund (R101); and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Protection Project Fund (R101) by $400,000.00. DISCUSSION: The Transportation and Public Works Department, Environmental Services Division contracts for professional environmental engineering services for a variety of tasks, including, but not limited to, underground storage tank investigations, groundwater monitoring, soil sampling and removal of contaminated soil, design and installation of remediation strategies and remediation site closures, Phase I and II Environmental Site Assessments, development of Storm Water Pollution Prevention Plans and Spill Prevention, Control and Countermeasures Plans and air pollution modeling. The current contract (City Secretary Contract 39673) with Enercon Services, Inc., for environmental and engineering consulting services was approved by City Council on November 3, 2009 by M&C C-23889. The contract was for one-year (January 14, 2010 -January 13, 2011) with the option for two one-year renewals. The City is executing the first renewal option (second 12-month term) and these funds are necessary for work anticipated to be performed in the second contract term. M/WBE -Enercon Services, Inc., is in compliance with the City's M/VVBE Ordinance by committing to 15 percent M/V1/BE participation on this first renewal option. The City's goal on this Renewal Option is 15 percent. This project serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available the the current operating budget, as appropriated, of the Environmental Protection Project Fund.
