HomeMy WebLinkAboutOrdinance 19520-01-2011Ordinance No. 19520-01-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $455,092.63, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF PROVIDING FUNDING FOR PHASE VI-b OF THE CITY'S ENERGY SAVINGS PERFORMANCE CONTRACT WITH JOHNSON CONTROLS, INC.; PROVIDING FORA SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $455,092.63, from available funds, for the purpose of providing funding for Phase VI-b of the City's Energy Savings Performance Contract with Johnson Controls, Inc. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. REFERENCE NO.: **G-17179 SUBJECT: Adopt Appropriation Ordinance Increasing the Estimated Receipts and Appropriations in the Special Trust Fund by $455,092.63 to Provide Funding for the City's Energy Savings Performance Contract with Johnson Controls, Inc. RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Trust Fund by $455,092.63. DISCUSSION: In June 2009, M&C C-23554 authorized application for and acceptance of a federal Energy Efficiency and Conservation Block Grant (EECBG) award. Since the $6.7M grant was awarded in September 2009 (CSC No. 39311), City staff has been working with Johnson Controls Inc., (JCI) and the federal Department of Energy (DOE) to develop two Energy Savings Performance Contract (ESPC) amendments: Phase VI-a for Water Fund facilities, and Phase VI-b for General Fund facilities. ESPC Amendment 7 for Phase VI-b is largely funded through the federal EECBG award, but also requires appropriation of additional incentive funds received from ONCOR Electric Delivery (ONCOR) for previous energy conservation projects. ONCOR promotes a commercial Standard Offer Program (SOP), providing incentives to Service Providers who install approved Energy Efficiency and Renewable Energy (EE/RE) in government and other facilities in their service area. The City has successfully participated in ONCOR's SOP, receiving incentives either directly from ONCOR orthrough aCity-contracted Energy Services Company (ESCo). A Conservation Reserve Account was established within the City's Special Trust Fund to receive any utility incentives secured through implementing Energy Conservation Program projects. In the course of implementing two program projects, ESPC Phase III (M&C C-21737) and LED Traffic Signals (M&C C-22063), utility incentives totaling $455,092.63 were subsequently received by the City and deposited into the Special Trust Fund account. ESPC Amendment 7 is included as a separate M&C on today's agenda. This appropriation ordinance must be approved prior to the approval of ESPC Amendment 7 to make the funds available for award. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Special Trust Fund.
