HomeMy WebLinkAboutOrdinance 19523-01-2011Ordinance No. 19523-01-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $31,200.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING COSTS ASSOCIATED WITH THE MANAGEMENT OF THE NEIGHBORHOOD AND COMMUNITY PARK DEDICATION POLICY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $31,200.00, from available funds, for the purpose of funding costs associated with the management of Neighborhood and Community Park Dedication Policy. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Improvements Fund by $167,592.00 from available funds; 2. Authorize the transfer of $167,592.00 from the Park Improvements Fund to the General Fund to offset operation and oversight costs associated with management of the Neighborhood and Community Park Dedication Policy; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Fund by $31,200.00 from available funds. DISCUSSION: The purpose of this M&C is to authorize the appropriation and transfer of funds to offset the costs related to the management of the Neighborhood and Community Park Dedication Policy ("Policy"). The Policy ensures the provision of adequate park and recreational areas with needed facilities in the form of neighborhood and community parks to serve population increases resulting from the addition of new residential units in the City. Park development fees and fees that are paid in lieu of making land dedications are placed in an interest bearing account and are used to achieve the Policy's objectives. Due to reductions in the Fiscal Year 2010 Adopted Budget, costs for operating and management of the Neighborhood and Community Park Dedication Policy were identified to be offset by interest income from these dedication and development fees. Expenses associated with the operation and management of the program include salary and benefits of City staff who administer the program as well as costs related to surveys and appraisals that are used in the acquisition of new parkland and setting of developer fees. Estimated revenue for salary and benefit expenses were set up during the Fiscal Year 2011 annual budget process. A supplemental appropriation in the amount of $31,200.00 is needed to fully fund the program. The remaining $136,392.00 has already been appropriated in the Fiscal Year 2011 General Fund adopted budget. Since 2000 when the current Policy was established, 869 acres and 50 new parks have been added to the Logname: 80FY11 PARK DEDICATION ADM COSTS Page 1 of 2 park system through this Policy. Since 2006 staff has inspected 28 new parks and continues to monitor the progress of approximately 47 future parks. This program serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the General Fund and the current capital budget of the Park Improvements Fund.
