HomeMy WebLinkAboutOrdinance 19526-01-2011Ordinance No. 19526-01-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $50,673.53 AND IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $14,915.33, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE STORM WATER UTILITY PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $50,673.53 and in the Sewer Capital Projects Fund in the amount of $14,915.33 from available funds, for the purpose of funding the Storm Water Utility Project - Berkshire-Hallmark Drainage Improvements, 150 Victorian Drive Drainage and Wedgwood Storm Drain Deleted. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $65,588.86 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $50,673.53 and the Sewer Capital Projects Fund in the amount of $14,915.33; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $50,673.53 and the Sewer Capital Projects Fund in the amount of $14,915.33 from available funds; and 3. Authorize the City Manager to execute Amendment No. 1 with Slater Engineering, Inc., in the amount of $262,746.60 to City Secretary Contract No. 35581, thereby, revising the total contract cost to $684,551.60. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. On September 22, 2009, (Ordinance No. 18838-09-2009) the City Council approved the issuance and sale of $45,000,000.00 in revenue bonds for Storm Water Capital Project Bond 2009 Fund, to fund atwo- year storm water capital project program. A Request for Qualifications (RFQ) to provide drainage design was issued by the City in January of 2006. Twenty-four design consultants submitted statements of qualifications, including Slater Engineering, Inc. Slater Engineering, Inc., was selected to provide design services for drainage improvements for the Berkshire-Hallmark Drainage Improvements and Wedgwood Storm Drain project (City Project No. 00480). On June 12, 2007, (M8C C-22173) the City Council authorized the City Manager to execute an engineering agreement with Slater Engineering, Inc., (City Secretary Contract No. 35581) in the amount of Logname: 20AMENDI_BERKSHIRE_HALLMARK Page 1 of 3 $421,805.00 for the design of Berkshire-Hallmark Drainage Improvements. The need for additional design scope, including water and sewer, has been identified. The original contract for the Berkshire-Hallmark project was based on recommendations from a drainage study completed in 2005. During design, the 2006 Stormwater Management Design Manual criteria was used and resulted in a change in the conceptual alignment for the Berkshire-Hallmark area and extension of the project limits for both the Berkshire-Hallmark and Wedgwood areas. In addition, the City now requires subsurface utility engineering and traffic control plans on all projects, which were not included in the original contract. Amendment No. 1 will provide the following: alignment study for the Berkshire-Hallmark subdivision, subsurface utility engineering, traffic control plans, additional survey, additional reproduction, additional design services for the Wedgwood subdivision, and additional design, bid phase, and construction phase services for a storm drain and water line design along Alava Drive. The Alava Drive portion of the project is new and was not part of the original contract. Slater Engineering, Inc. proposes to perform the design services for a lump sum fee of $262,746.60. City staff considers the fee to be fair and reasonable for the scope of services proposed. The estimated construction cost of the total project is $8,620,000.00. The project includes four project locations and it is anticipated will be bid as four separate bid packages. The construction estimate for each location is as follows: Berkshire-Hallmark ($4,920,000.00), Victorian Drive ($50,000.00), Wedgwood ($3,040,000.00), Alava Drive ($610,000.00). Slater Engineering, Inc., agrees to maintain its initial M/WBE commitment of 21 percent that it made on the original agreement and extend and maintain that same M/WBE commitment of 21 percent to all prior amendments up to and inclusive of this Amendment No. 1. Therefore Slater Engineering, Inc., remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 6, Mapsco 89Q, 89U and 103C. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Storm Water Capital Project Bond 2009 Fund, the Water Capital Projects Fund, and the Sewer Capital Projects Fund and in the current operating budget, as appropriated, of the Water and Sewer Fund.
