J v D _ (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Teague Nall and Perkins, Inc. , (Engineer) made and entered into City Secretary Contract No. 33830, (the Contract) which was authorized by the City Council by M&C C-21582 on the 25th day of July, 2006 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LXXIV (74) . WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23595, adopted by the City Council on the 16th day of June 2009, and further amplified in a proposal letter dated March 2, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $34, 921 .00. 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $245, 926.00. Authorize the transfer of$34,921.00 from the Water and Sewer Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$34,921.00, from available funds; and 3. Authorize the City Manager to execute Amendment No. 2 in the amount of$34,921.00 to City Secretary No. 33830, with Teague Nall and Perkins, Inc., for Sanitary Sewer Rehabilitation Contract LXXIV for additional engineering services thereby increasing the contract amount to $245,926.00. DISCUSSION: On July 25, 2006, (M&C C-21582) the City Council authorized the City Manager to execute an Engineering Agreement with Teague Nall and Perkins, Inc., in the amount of$202,705.00 for Sanitary Sewer Rehabilitation Contract LXXIV (74) (Project 00360). The original scope of services provided design services for the replacement of deteriorated sanitary sewer laterals and mains located in all Council Districts. The Agreement was subsequently revised by Amendment No. 1 in the amount of$8,300.00, administratively approved by the City Manager on September 24, 2007, that provided for additional survey on the project. Teague Nall and Perkins, Inc., proposes to perform the necessary additional design work for a lump sum fee of$34,921.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. Additional M/WBE participation is not necessary on this amendment due to the fact that the requested amount is less than $50,000.00. The improvements proposed in this amendment are located in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund. The following is a brief description and cost for the additional services provided on this project: Additional Field Services Based on our recommendations and subsequent meetings with the City, several lines need additional design effort to complete this project. The following are the lines and a general description of work required. ■ L-2150—A recommendation by City Staff per the M-272D2 drainage study was to include replacement of the segment between Sta. 11+00 and 17+20. Adding this to our project will join the east and west sections that we are currently designing for replacement; ■ L-6665— In order to avoid the replacement of a 26' deep manhole and sewer line, 750 feet of line(Alternate#3)along the creek will be re-aligned(requires additional easement); ■ L-2139—This item includes replacement of approximately 410 feet of pipe upstream from the section included in this project where the existing concrete pipe shows cracking in several locations and an obstruction 292 feet from the upstream manhole where TV inspection had to be abandoned; ■ L-2876 — add an additional 80 feet of pipe to re-align the sewer line and avoid damaging or destroying the large oak tree at the Ridglea Country Club entrance; ■ L-4523—This sewer main will be realigned down Driskell to Bonnell and within the right-of-way to an existing line in a shorter distance than if replaced in its current alignment. Seven services will require realignment to the sewer main in the street.
