HomeMy WebLinkAboutContract 33830-A1 AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT (MSC Not Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and DeOtte, Inc. , (Engineer) made and entered into City Secretary Contract No. 33830, (the Contract) which was authorized by the City Council by MSC C-19702 on the 12th day of August, 2003 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Walsh Ranch Sewer Main Extension, Phase 1C WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised max;Mwn fea; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated February 3, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $38,700.00. 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $206,891.00. City of Fort Worth Water Department 1000 Throckmorton Fort Worth,TX 76102 SUBJECT: AMENDMENT 1 ENGINEERING AGREEMENT FOR WALSH RANCH SEWER MAIN EXTENSION,PHASE 1C PROJECT No: PS46-070460140300 CITY SECRETARY CONTRACTOR No: 29013 DOE No: 4160 Dear Mr. Conlon: On September 4, 2003, DeOtte, Inc. received the official Notice to Proceed to perform professional services as outlined in the engineering agreement. In approximately November 2004, plans and specifications were submitted to the City for review. Sometime after,the overall project was placed in a hold status. Recently, the City requested an amendment proposal from DeOtte, Inc. to update and revise the submitted plans based on new information which included revisions to the vertical profile of the pipe to account for future development and revisions to the horizontal alignment to avoid a future bridge which was determined to be in conflict with the existing alignment. Additionally, the sewershed was revised to incorporate certain new areas and eliminate certain existing areas due to revisions to the development plan which altered the area served by this sewer extension. This sewershed revision as well as the horizontal and vertical revisions to the line will require new hydraulic and pipe sizing analysis throughout the entire length of the line. Since the original submission of the plans,design software used for the production of construction plans has changed dramatically. The fees below include the effort necessary to import and update existing and planned base file information into current design software currently being utilized for plan production. Also, the City has significantly changed its operating procedures, project management system and contract document templates since the original submission of the design package. The fees below include the effort required to update all of the plan and specification documents to current City standards and to comply with the City's Integrated Project Management System (IPMS) through the use of Buzzsaw, project reporting and scheduling. The specifications will also be updated to reflect appropriate bid quantities based on the changes in scope. The design revisions need to be coordinated with the Engineer of Record for Walsh Ranch. Additional coordination will be required to ensure that existing easements are properly abandoned and new easements are properly acquired as necessitated by changes to the horizontal alignment. Also,additional meetings and coordination will be required with the City to update and review the new design package. The fees below also incorporate extended overhead expenses incurred by DeOtte, Inc. for the maintenance of the design contract and additional reporting required by the extraordinary length of the hold status, more specifically M/WBE reporting which was required over the majority of the duration of the hold,over 5 years. Construction administration fees are not anticipated to require any amendment at this time. The M/WBE goal established in the original contact is 20%. The total amount already paid to M/WBE subcontractors is $46,731.47 or 22.6% of the resultant contract value after the execution of Amendment 1.
