HomeMy WebLinkAboutContract 33935 AMENDMENT NO. 1 STATE OF TEXAS § CITY SECRETARY CONTRACT NO.&Iicm COUNTY OF TARRANT § WHEREAS, the City of Fort Worth, a municipal corporation situated in Tarrant County, Texas hereinafter called"City" and Camp Dresser &McKee Inc., here after called "Engineer"made and entered into City Secretary Contract No. 27797(the Contract) which was authorized by the City Council by M&C C-19114 on the 4th day of June 2002. WHEREAS, the Contract involves engineering services for the following project: Village Creek Wastewater Treatment Plant Trinity River Pipeline Crossing (Parallel Siphon) Project Number P171-070171300040 CIP 00186 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified a proposal letter dated November 4, 2005, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $ 333,113. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to the Engineer for all work done and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$ 632,742.00. 3. Our understanding of the proposed changes in scope include: expansion of the limits of the tree survey,inclusion of documents to inspect and rehabilitate Boxes E/EE and D/DD, addition of construction documents for the installation of washer/compactor no.5 at the Village Creek Wastewater Treatment Plant(Plant) Headworks Facility, modifications to Bar Screen Building No.3, and Construction Management services for construction of the siphon pipeline, structures,installation of the washer/compactor and the modifications to Bar Screen Building No. 3. In additional to these proposed changes, CDM is requesting the amendment include design work completed for the siphon project that is outside the original scope of work. Presented below are the items completed that are out of scope and the proposed work. A summary of the fee for all the items are contained on Attachment 1. I. Additional Work Performed: A. Identification and Tagging of Trees within the Total Easement Area For approval of the COE Regional Permit,negotiation of the loss of mitigation banking credits and compliance with the City's new Tree Ordinance, a more detailed tree survey,including identification and tagging of trees is needed. The estimate fee for the tree survey is $$6,700.00, which is detailed on Attachment 1. Boxes DDD, ED2 and ED3 The original design fee included the design of one junction structure connecting the existing gravity sewer lines north of the river,one siphon line crossing the river, and one connection at the future Box EEE. During the course of design the configuration and dimensions of Box DDD was modified several times. The changes will give the City more flexibility in the future and allow connection of future lines and siphon easier. However, this is a condition not anticipated under the original scope of work and the budget was exceeded for this item. Also,two additional structures were added to the project Box ED2 and ED3. The expenditures for this additional work including subconsultant's work are$24,200.00. A detailed breakdown is shown on Attachment 2. A copy of the Subconsultant's correspondence regarding the additional work is located at the end of this letter. II. Additional Work to Perform: A. Rehabilitation of Junction Boxes EE,D and DD. CDM and subconsultant JQ will prepare construction documents, including drawings and specifications for the rehabilitation of Junction Boxes D, DD and EE. The repairs and improvements include the application of repair mortars to the deteriorated concrete structures and the applications of a protective liner to all interior concrete surfaces after repair. This work will be included in the siphon plans. The rehabilitation will be included in the bid proposal as alternate add items. Due to the straight forwardness of the work and the accelerated schedule,only one submittal (100% complete) will be made to the City. During the bidding phase,CDM / JQ will answer questions and issue addenda as appropriate to interpret,clarify,or expand the bid documents. CDM/ JQ will also attend the prebid conference,bid opening and prepare a bid tabulation. After review of the bids, CDM will provide a written recommendation of award to the City. November 4, 2005 Page 3 The total estimated engineering fee for the rehabilitation of Junction Boxes EE and D/DD is $35,737. The estimated is shown in detail on Attachment 1. A copy of JQ's proposal is located at the end of this letter. B. Installation of Washer/Compactor No.5: Proposed work at the Headworks Facility for the plant includes installation of a new washer/compactor, associated electrical and instrumentation additions and modifications,and associated discharge piping for fine screen no.5. CDM will prepare construction drawings and contract specifications for the addition of Washer/Compactor No. 5. The construction plans from the HRC cannot be used as they were based on a different Washer/Compactor model. This work will be included in the siphon plans. Due to the straight forwardness of the work and the accelerated schedule,only one submittal (100% complete) will be made to the City. CDM will provide a detailed opinion of probable construction cost for the installation of the washer/compactor No. 5 and associated work. During the bidding phase,CDM will answer questions and issue addenda as appropriate to interpret,clarify, or expand the bid documents. CDM will also attend the prebid conference,bid opening and prepare a bid tabulation. After review of the bids,CDM will provide a written recommendation of award to the City. The total estimated engineering fee for the addition of the Washer/Compactor No.5 is$20,833. A detailed estimate is shown on Attachment 3. C. Modification to Bar Screen Building No.3: The proposed work at Bar Screen Building No. 3 includes preparing construction drawings and specifications for the following: n o.pA O� K!"lG;dl CITY izc.e CDM Ms. Madelene Rafalko, P.E. November 4, 2005 Page 4 • demolition of parshall flumes 5 and 6 and associated instrumentation equipment, • installation of 96-inch Hobas pipe to connect the 96-inch RCP influent pipe to the bar screen structure, • demolition of odor control ductwork, and • odor control improvements for the building. Odor control improvements for Bar Screen Building No. 3 consist of new FRP ductwork and an exhaust fan to exhaust odors from parshall flume 7, the bar screen room and the screening loading area. Field Surveying services are also included to aid in preparation of the drawings. This work will be included along with the Washer/Compactor portion in the siphon plans. Due to the straight forwardness of the work and the accelerated schedule, only one submittal (100% complete) will be made to the City. CDM will provide a detailed opinion of probable construction cost for the modifications at Bar Screen Building No.3. During the bidding phase,CDM will answer questions and issue addenda as appropriate to interpret,clarify,or expand the bid documents. CDM will also attend the prebid conference,bid opening and prepare a bid tabulation. After review of the bids,CDM will provide a written recommendation of award to the City. The total estimated engineering fee for the modifications to Bar Screen Building 3 is $59,930. The detailed estimate is shown on Attachment 3. D. Construction Phase Services The construction phase services include the following: a. Attending preconstruction conference, shop drawing review,providing interpretations and clarifications of the Contract Documents to the Contractor, and preparation of record drawings. This portion of the construction phase includes the installation of the washer/compact and the modifications to Bar Screen Building#3. Construction pha ��-��'�- �•�w�'� CDM IIs. Madelene Rafalko,P.E. November 4, 2005 Page 5 services have not been included for the rehabilitation of the junction structures. A construction duration of 15 months is anticipated to allow for two possible dry weather periods. Our estimated engineering fee for the construction phase services listed above is$39,641 and is detailed on Attachment 4. b. Part-time resident representation and attending monthly progress meetings. This portion of the construction phase includes the following work items;the siphon project, addition of washer/compactor no.5, modifications to Bar Screen Building No. 3. The original design fee for the siphon project did not include part-time resident representation as it was thought the HRC construction and siphon construction would be concurrent and would be observed within the HRC resident representation budget. A construction duration of 15 months is anticipated to allow for two possible dry weather periods. Our estimated engineering fee for the construction phase services listed above is$143,072 and is detailed on Attachment 4. Construction phase services do not include the rehabilitation of Junction Boxes D, DD and EE, since these items will be alternative bid items. The fee for construction administration for the rehabilitation of the boxes will be provided in a separate proposal after bidding and award. For budgetary purposes,we can provide an estimated fee of$12,000 for construction phase services for rehabilitation of the boxes. The total estimated engineering fee for the items listed above is$330,113. It is a requirement to have the COE Regional Permit prior to advertising the project for bids. As you are aware, we are diligently working with COE to get comments on the permit application and resolve any issues. It is desirable to have the permanent and temporary easement documents signed prior to advertising for bids. However,in extreme cases, the City has advertised the project with outstanding easement acquisitions. DISCUSSION: On June 4, 2002, (M&C C-19114) the City Council authorized the execution of an engineering agreement with Camp Dresser & McKee, Inc., for the design and preparation of construction documents for a third parallel siphon pipeline under the Trinity River to the Village Creek Wastewater Treatment Plant and an upstream siphon interconnection structure, and the preparation of applications for Corps of Engineers permits. Proposed Amendment No. 1 is for Camp, Dresser & McKee, Inc., to provide construction administration services and resident representation/inspection during the construction phase. This was not included in the original design agreement as the project was scheduled to be constructed concurrently with the Village Creek WWTP High Rate Clarification (HRC) Improvements with a single construction administration team for both projects. However, this project was delayed to ensure plant staff had sufficient time to become familiar with the new treatment process. Also, the construction process will require a tree survey to meet the City's new tree ordinance. In addition, the Engineer will design a larger upstream diversion structure to span the parallel 96-inch pipelines with gates and stop logs to allow control of the downstream flow and two additional structures on the new pipeline for improved access for maintenance of the siphons. As part of this work, the existing siphon junction boxes will require rehabilitation due to severe corrosion. The Engineer will also design the removal of Influent Flumes 5 and 6 for increased head-works capacity and the air scrubber modifications to Bar Screen Building No. 3 necessary to improve the air quality in the building to provide a safe working environment. Camp Dresser & McKee, Inc. is in compliance with the City's MWBE Ordinance by committing to an additional 20% MWBE participation on this Amendment No. 1. The City's goal on this amendment is 20%. In addition to the contract cost, $10,000 is required for city staff review.
