HomeMy WebLinkAboutContract 33948 AMENDMENT NO. 1 STATE OF TEXAS § CITY SECRETARY CONTRACT NO3. ?—A+ § (No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and Turner, Collie&Braden ("Engineer") made and entered into City Secretary Contract No. 31796, (the "Contract") which was authorized by the City Council by M&C—C20670 on the 26th day of April, 2005 ; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Lancaster Avenue Reconstruction . WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to included the additional engineering services specified in a proposal letter dated March 21, 2006, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $24,900.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the contract, as amended, so that the total fee paid by the city for all work and services shall not exceed the sum of$ 203,730.00. 3. All other provision of the Contract which are not expressly amended herein shall remain in full force and effect. EXECUTED on this the day of ,2006 in Fort Worth, Tarrant County, Texas. The 5 items are: 1. Additional Survey for Frank Kent 2. Coordination/Design Changes for Art Work within the Medians 3. Additional Design Changes 4. Additional Site Visits 5. Work for 1933 UGE At that meeting,and additional meetings,we decided that a supplemental would not be requested for Items 1 and 2 at alis time, but could be revisited at a later date. Additional Design Changes The May 16, 2005 contract states that TCB will perform 5 Change Orders. TCB performed 10 design changes between Mat and January based on requests from the City of Fort Worth and TxDOT. These design changes are listed below: • Revised removal sheets and grading sheets to leave existing sidewalk in place and remove additional curb and gutter based on TxDOT request. • Removed retaining wall at T&P Warehouse. • Removed Trench Drain at T&P Warehouse and redesigned portions of Storm Drain Line B. • Addition of Fiber Optic Conduit between Monroe and Jennings. • Better data was collected on some utilities after the design and thus Line A9, Lateral B1, Lateral D1, and Lateral F2 were revised to avoid conflicts with utilities. • Storm Drain revisions for Laterals B1, 64, D1, F2, F3, G1, and G4 were made based on TxDOT request so that the storm drain trench would cross the 1933 UGE conduit perpendicularly instead of at a skew. UNKNA11 ROD Page 2 • Prepared plans to replace and coat an existing sanitary sewer manhole north of the Post Office based on request by the City of Fort Worth. Upon visiting the site and coordinating with the City of Fort Worth, a Field Change was made to leave the existing manhole in place, since it was recently installed. • Entrances to P.O. Parking Lot had to be redesigned to match proposed parking lot grade. The change was necessary since the grade of the post office parking lot was requested to be modified by the City of Fort Worth after the roadway design plans were prepared. • Removed steel curb drain at northeast corner of Throckmorton and 15th Street. The steel curb drain was designed to drain storm water from the property to the east of Throckmorton and north of Lancaster. The curb drain in this location was not aesthetically pleasing, and thus it was removed. A drop inlet and storm drain were designed to drain the subject area. • A Storm Drain and Sanitary Sewer were redesigned at 15th St. and Throckmorton to avoid a conflict with an electrical conduit used to power billboard and gate, based on a request from the City of Fort Worth. Although the number of design changes listed above exceed the contracted amount, TCB is not requesting additional services for the said design changes. TCB is, however, requesting additional compensation for three additional design changes to the contract. These design changes include redesigning storm drain Laterals F2 and F3, redesigning storm drain Laterals G3 and G4, and modifying the curb location west of West 15th Street along Lancaster Avenue. Laterals F2 and F3 were modified to prevent the storm drain crossing TXU's 138 KV line. Laterals G3 and G4 were modified to go around a TXU utility duct, and a gas-line whose elevations were not previously known. The curb of Lancaster is to be moved 6-in to the north to prevent a conflict with TXU's vault between West 15th Street and Houston Street. The anticipated effort to perform the 3 design changes is$7,965. Additional Site Visits The May 16, 2005 contract stated that the cost for the site visits was determined based on the quantity of site visits. To date,there have been 34 site visits/meetings attended, which exceeds the contracted amount of 30. TCB requests $1,200 for the meetings attended that exceeded the contract and for anticipated meetings. Work for 1933 UGE Conduit The City of Fort Worth agreed to protect TXU's 1933 duct bank along the south side of Lancaster. To assist TXU in protecting the duct bank, the City of Fort Worth asked TCB to provide two different sets of plan sheets, one for the City of Fort Worth, and a second for TXU, to show the top of 1933 conduit and the proposed bottom of HMAC base above the duct bank. Two sets of plans were prepared so that if TXU could not provide the work to protect the line, then the City of Fort Worth could issue the plans to a contractor to provide a portion of the work. The work/coordination required to prepare the plan sheets were not covered in the original construction phase contract. TCB has prepared sheets showing the bottom of base along the TXU distribution line for Lancaster, Monroe, Jennings, Throckmorton, 15th Street, and Commerce/S. Main. TCB request$15,735 for compensation for preparing the plans and for ongoing coordination efforts with TXU.
