HomeMy WebLinkAboutOrdinance 18557-04-2009Ordinance No. 18557-04-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $528,099.50, SUBJECT TO RECEIPT OF THE COMPREHENSIVE SELECTIVE TRAFFIC ENFORCEMENT PROGRAM GRANT AND THE COMMERCIAL MOTOR VEHICLE SELECTIVE TRAFFIC ENFORCEMENT PROGRAM GRANT FROM THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE PURPOSE OF FUNDING AND IMPLEMENTING INCREASED ENFORCEMENT OF TRAFFIC SAFETY-RELATED LAWS AND TO INCREASE PUBLIC EDUCATION ABOUT TRAFFIC SAFETY ISSUES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $528,099.60 subject to receipt of the Comprehensive Selective Traffic Enforcement Program Grant and the Commercial Motor Vehicle Selective Traffic Enforcement Program Grant from the Texas Department of Transportation for the purpose of funding and implementing increased enforcement of traffic safety-related laws and to increase public education about traffic safety issues. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the Gity Manager to enter into a contract with the Texas Department of Transportation for the Gomprehensive Selective Traffic Enforcement Program and Commercial Motor Vehicle Selective Traffic Enforcement Program grant implementation during Fiscal Year 2010, contingent upon appropriation of matching funds; 3. Authorize the transfer of $68,105.70 from the Federal Awarded Assets Fund to the Grant Fund for the Gity's partial match of the Comprehensive Selective Traffic Enforcement Program and Commercial Motor Vehicle Selective Traffic Enforcement Program grant, contingent upon receipt of adequate funding in the Fiscal Year 2010 Federal Awarded Assets fund; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Grants Fund by $528,099.60, subject to receipt of the Comprehensive Selective Traffic Enforcement Program grant and the Commercial Motor Vehicle Selective Traffic Enfarcement Program grant. Travel expenses for the attendance of one Lieutenant and administrative assistant at a Texas Department of Transportation conference is budgeted at $556.00. The Commercial Motor Vehicle STEP grant activities include enforcement specially related to commercial motor vehicles. The total proposed grant with matching funds is $69,262.00 Grant funds of $52,600.00 are budgeted for 1,010 enforcement overtime hours and $9,420.67 for fringe benefits. An additional $4.781.32 is budgeted for overtime hours and fringe benefits required for administrating the grant. Fifteen hours of overtime is budgeted to work public information and education events at $893.17 and $1,000.00 for public information and education materials. Travel expenses for the attendance of one Sergeant at a Texas Department of Transportation conference is budgeted at $566.84. FISCAL INFORMATION I CERTIFICATION: __ The Financial Management Service Director certifies that upon approval of the above recommendations and execution of the contracts, adoption of the attached appropriation ordinance and upon approval of the proposed Fiscal Year 2009-2010 budget, funds will be available in the 2010 Fiscal Year budget as appropriated of the Grants Fund.
