HomeMy WebLinkAboutOrdinance 19561-03-2011ORDINANCE NO. 19561-03-2011 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF EXCESS RIGHT-OF-WAY, GRACE STREET, ALONG THE WEST BOUNDARY LINE OF LOT 1, BLOCK 1, DETENTION CENTER COMPLEX, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED VOLUME 388-55, PAGE 60 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING APPROXIMATELY 6,816 SQUARE FEET OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of excess right-of--way, Grace Street, along the West boundary line of Lot 1, Block 1, Detention Center Complex, an addition to the City of Fort Worth, Tarrant County, Texas as recorded Volume 388-55, Page 60 of the Plat Records of Tarrant County, Texas, and containing approximately 6,816 square feet or 0.156 acre of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Said 5.0 foot wide strip of land being more particularly described by metes and bounds as follows: BEGINNING at a'/z" iron rod marked "Brittain & Crawford" set, at the Northwest corner of Lot 1-R, Block 1, Detention Center Complex, an addition to the City of Fort Worth, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 3303 of the Plat Records of Tarrant County, Texas, and said POINT OF BEGINNING also lying in the South right-of-way line of Premier Street; THENCE S 00° 14' 34" E 1362.49 feet, along the West boundary line of said Lot 1-R to a point at the Southwest comer of said Lot 1-R, lying in the North right-of-way line of Kimbo Street; THENCE S 74° 44' 48" W 5.18 feet, along the North right-of-way line of said Kimbo Street to a'/2" iron rod found; THENCE N 00° 14' 34" W 1363.76 feet, along a line 5 feet West of, and parallel to the West boundary line of said Lot 1-R to a point in the South right-of-way line of aforesaid Premier Street; THENCE N $$° 57' 24n E 5.00 feet, along the South right-of-way line of said Premier Street to the POINT OF BEGINNING containing 0.156 acre (6,816 square feet) of land. ~~j .., .~ >. No, 19561-03-2x11 DATE: Tuesday, March 01, 2011 REFERENCE NO.: **PZ-2927 LOG NAME: 060065030 VA-009-036 SUBJECT: Adopt Ordinance Vacating a Portion of Excess Right-of-Way for Grace Street Between Premier Street and Kimbo Road (COUNCIL DISTRICT 4) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating a portion of excess right-of-way for Grace Street between Premier Street and Kimbo Road; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G- 15624). DISCUSSION: Brittain and Crawford, LLC, on behalf of Tarrant County, has requested the vacation of the above referenced right-of-way to replat the right-of-way with the adjoining property for the future expansion of the Tarrant County Youth Detention Center Complex. The City Plan Commission recommended approval of this request at its meeting on November 20, 2009. An acceptable replat (FS-009-121) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own land on either side of the above referenced public right-of-way. Since no City funds have been expended to purchase property or easement rights, collection of the fair market value or any portion thereof is recommended by staff to be waived. This land is located in COUNCIL DISTRICT 4. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that this action will have no material effect on City funds.
