CONNER SURVEY, ABSTRACT 288, IN THE CITY OF FORT WORTH AS RECORDED IN VOLUME 940, PAGE 158, VOLUME 941, PAGE 17 AND VOLLUME 938, PAGE 424 OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS; AND CONTAINING APPROXIMATELY 4,572 SQUARE FEET OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of public right-of--way along Riverfront Drive east of Rogers Road, located in a tract of land situated in the W.D. Conner Survey Abstract 288, in the City of Fort Worth as recorded in Volume 940, Page 158, Volume 941, Page 17 and Volume 938, Page 424 of the Deed Records of Tarrant County, Texas, and containing approximately 4,572 square feet of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. The City Manager is hereby authorized to execute a deed without warranty and the necessary documents of conveyance of the rights-of--way described in Exhibits "A" and "B", to the adjacent property owners for fair market value already received. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. That this ordinance shall take effect upon adoption. D. Adopt the attached ordinance vacating a portion of right-of-way along Riverfront Drive east of Rodgers Road; and 2. Authorize the City Manager to execute any necessary conveyance documents. DISCUSSION: Transystems, on behalf of the Tarrant Regional Water District (TRWD), has requested the vacation of the above referenced right-of-way to replat the right-of-way with the adjoining property for a future trailhead development. The City Plan Commission recommended approval of this request at its meeting on August 26, 2009. An acceptable replat (FS-009-135) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City holds fee simple title to the property to be vacated. On January 25, 2011, the City Council approved M&C C-24682, which authorized the execution of an agreement with TRWD to exchange the subject property for certain TRWD property to enable the construction of a trailhead facility. The parking area is along Riverfront Drive between University Drive and Rogers Road. This land is located in COUNCIL DISTRICT 9.
