AMENDMENT TO RESTATED INTERLOCAL COOPERATIVE AGREEMENT
WHEREAS, the City of (the "Jurisdiction"), together with other
municipalities in Tarrant County, Texas, adopted that certain Restated EMS Interlocal
Cooperative Agreement (the "Agreement") pursuant to the provisions of Chapter 791 of the
Texas Government Code (the "Interlocal Cooperation Act") and a Uniform EMS Ordinance (the
"Ordinance") to provide emergency and non-emergency ambulance services in this Jurisdiction
and in the other member jurisdictions;
WHEREAS, pursuant to Section 791.013 of the Interlocal Cooperation Act, the Area
Metropolitan Ambulance Authority d/b/a MedStar (the "Authority") was created as an
administrative agency, through the adoption of the Agreement and the Ordinance, to supervise
the performance of the Agreement;
WHEREAS, this Jurisdiction, together with the other member jurisdictions, desire to
amend the Agreement to allow the Authority the right to operate the ambulance system.
NOW, THEREFORE, in consideration of the mutual covenants and agreements herein
contained, this Jurisdiction hereby agrees that the Agreement shall be amended as follows:
1. Unless otherwise defined herein, all capitalized terms used herein shall have the
same meaning as defined in the Agreement, unless the context hereof otherwise requires.
2. Paragraph 2(a) of the Agreement is hereby amended to read in its entirety as
follows:
"The existence of the Authority is perpetual. This Jurisdiction may
not withdraw until July 31, 2004. Thereafter, this Jurisdiction may
withdraw on (i) the termination date of the contract for ambulance
services with the contractor, and the expiration dates of all options
for extension thereof, if a competitively selected private contractor
is the operator of the ambulance system, or (ii) the last day of the
fiscal year of the Authority, if the Authority is the operator of the
ambulance system. Notice of such intention to withdraw shall be
given in writing to the Authority, and to each member jurisdiction
thereof not less the twelve (12) months before the proposed
effective date of withdrawal."

3. Paragraph 7 of the Agreement is hereby amended to read in its entirety as follows:
"The ambulance service shall be operated by either the Authority
or a competitively selected private contractor, as determined by the
Authority's Board of Directors. If the Authority is the operator of
the ambulance service, the Authority shall:
(a) commencing with its fiscal year ending in the year
2006 and continuing every other fiscal year
thereafter, prepare and provide to each member
jurisdiction a report which will provide a
comprehensive review and summary of the
financial, clinical and operational performance of
the ambulance system during such fiscal year. This
report must be submitted to the member
jurisdictions no later than 120 days after the end of
the fiscal year; and
(b) commencing with its fiscal year ending in the year
2007 and continuing every other fiscal year
thereafter, provide to each member jurisdiction an
audit of the financial, clinical and operational
performance of the ambulance system during such
fiscal year prepared by a qualified and independent
third party. This audit must be submitted to the
member jurisdictions no later than 120 days after
the end of the fiscal year. "
4. Paragraph 9(c) of the Agreement is hereby amended to read in its entirety as
follows:
"To operate the ambulance service or to award the operation of the
ambulance service to a private contractor by way of a Request for
Proposal process. The operator of the ambulance service, be it the
Authority or a private contractor, shall be required to provide all
ambulance services in each member jurisdiction, except for those
exempted in Section 6(f) of the Uniform EMS Ordinance (Exhibit
A) adopted concurrently herewith."
5. Except as otherwise expressly provided herein, all of the terms, conditions,
defined terms, covenants, representations, warranties and all other provisions of the Agreement
are not amended, modified or affected by this Amendment. Except as expressly set forth herein,
all of the terms, conditions, covenants, representations, warranties and all other provisions of the
Agreement are herein ratified and confirmed and shall remain in full force and effect.

6. On and after the date of this Amendment, the terms "Agreement," "hereof,"
"herein," "hereunder," and terms of like import when used in the Agreement shall, except where
the context otherwise requires, refer to the Agreement as amended by this Amendment.

Approve the FY2006-07 Area Metropolitan Ambulance Authority d/b/a MedStar Subsidy in the
Amount of$1,311,021 for Ambulance Services
RECOMMENDATION:
It is recommended that the City Council approve the FY2006-07 Area Metropolitan Ambulance Authority
d/b/a MedStar subsidy in the amount of$1,311,021 for ambulance services.
DISCUSSION:
As required by the EMS Interlocal Agreement (City Secretary Contract Number 24507), the Area
Metropolitan Ambulance Authority (MedStar) annually produces a schedule of price/subsidy options, so that
each city may select its own transport price and/or per capita tax subsidy. The schedule of price/subsidy
options was prepared utilizing population estimates provided by the North Central Texas Council of
Governments for 2006.
During the FY2006-07 budget process, the City Council approved a subsidy to be included in the budget in
the amount of $1,311,021 for MedStar for emergency transport services. This subsidy amount set the per
capita support of the MedStar system at $1.98. The per capita subsidy is determined by dividing the
FY2006-07 budget appropriation of$1,311,021 by Fort Worth's population of 661,850 provided by the North
Central Texas Council of Governments.
This subsidy will result in an average estimated bill of$1,046 for Emergency Ambulance Services and $642
for Non-Emergency Services provided in Fort Worth.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current operating budget, as appropriated, of
the General Fund.
