AMENDMENT NO. 1 TO CITY OF FORT WORTH
CITY SECRETARY CONTRACT NO. 15712 WHITE SETTLEMENT
WHOLESALE WASTE WATER CONTRACT
WHEREAS, on the 12th day of May, 1987, the cities of Fort Worth and
White Settlement entered into City of Fort Worth City Secretary Contract No.
15712 providing for the treatment of wastewater by the City of Fort Worth on
behalf of the City of White Settlement; and
WHEREAS, Fort Worth desires to provide sanitary sewer to certain
properties within the Fort Worth city limits via a connection to the White
Settlement wastewater system at the approximate location shown on Exhibit "A";
and
WHEREAS, the White Settlement wastewater system has capacity
sufficient to accommodate the properties within the Fort Worth City limits; and
WHEREAS, the cities of Fort Worth and White Settlement desire to amend
Contract No. 15712 to provide for cost recovery of wastewater service to the
areas in the City of Fort Worth as shown on Exhibit "A";
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS:
That this amendment to CMw�

15712 is made this , `� day of 2006 by the City of Fort Worth,
acting herein by and through Marc A. Ott, its duly authorized Assistant City
Manager and the City of White Settlement, acting herein by and through Jimmy
Burnett, its duly authorized City Manager, the parties do hereby agree as follows:1.
Paragraph 31 of City of Fort Worth City Secretary Contract No. 15712 is
amended to add subparagraph 31.9, which shall be and read as follows:
31.9 Customer agrees to permit Fort Worth to connect to its wastewater
system at a point shown on Exhibit "A" for the following purposes and
consideration:
a. Fort Worth shall be permitted to discharge no more than a monthly
average of 35,000 gallons per day of wastewater (the "Fort Worth
Flow") generated from the shown on the attached Exhibit "X.
b. Fort Worth shall install metering and telemetry facilities at the metering
station adjacent to the Shoreview Lift Station, as agreed upon by the
parties, to be used to determine the amount of the Fort Worth Flow.
As between Customer and Fort Worth, Fort Worth shall be responsible

to pay all costs for the installation, operation, repair and maintenance
of the metering and telemetry facilities for the Fort Worth Flow, except
as such costs may be included as Fort Worth System Costs.
c. 'Fort Worth shall bill Customer in a manner that deducts the Fort Worth
connection flows transported by White Settlement from the total Fort
Worth metered volumes on the monthly bill. In addition Fort Worth shall
credit against the bill a transportation fee based on the pro rata share
for the Fort Worth Flow of actual operation and maintenance costs of
the Shoreview and Lariat Lift Stations ($0.7532/1000 gal. per current
calculations). The transportation fee maybe recalculated at the time of
any change to the Fort Worth Wholesale Wastewater Volume Rate.
Each bill shall set forth an itemization and deduction for the amount of
metered or calculated volumes delivered to the White Settlement
system and transportation fees attributable to wastewater flow from
Fort Worth. Said amounts shall be credited/deducted from the total
amount owing to Fort Worth by Customer pursuant to the Contract No.
15712. .
d. If the Fort Worth Flow exceeds a monthly average of 35,000 gals. per
day and Customer determines that the lift station requires additional
pumping capacity, Fort Worth shall be responsible for the cost to
accommodate the additional Fort Worth Flow through the lift station.
Fort Worth agrees to pay its pro rata share of the improvements to
accommodate the additional flows within 60 days of the receipt of the
invoice from White Settlement.
e. White Settlement agrees to allow a temporary unmetered connection
for a period of time not to exceed 120 days from the date of the
execution of this amendment. During the unmetered period flow rates
from Fort Worth connections shall be calculated at 10,500 gal.
/month/connection for each residential connection and actual metered
water use for each non-residential connection. Credits for Fort Worth
Flow shall be calculated as described in Section 31.9.c. above.
f. If Fort Worth makes any temporary connections and fails to make a
permanent metered connection within 120 days as specified above,
then O&M cost credits as shown in Section 31.9. c. shall be calculated
with an additional 20% until the metered connection is made. If the
metered connection is not made within 180 days as specified above
then any temporary connection shall be terminated and this agreement
declared null and void.
g. In addition to the pro rata share that Fort Worth agrees to pay for future
improvements to the Shoreview Lift Station pursuant to subsection (d),
Fort Worth shall pay a one-time lump sum of $11,682.00 to the City of
White Settlement as its pro rata contribution for the construction of the
Shoreview Lift Station.

All other terms, conditions, and covenants contained in City of Fort Worth City
Secretary Contract Nos. 15687 and 17210 not amended herein continue in full
force and effect and are unaffected hereby.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute attached Amendment No.1
to the City of White Settlement's Wholesale Wastewater Contract.
DISCUSSION:
The Fort Worth Water Department has been in negotiations with the City of White Settlement to allow a
connection to their sewer system at their Shoreview Lift Station in order to provide sewer service for 32 Fort
Worth customers along Shoreview Drive, Killdeer Circle, Abelia Court and Bomber Road. The City of White
Settlement has agreed to provide sewer service under the following conditions:
• Fort Worth will install metering and telemetry facilities to measure the Fort Worth flows entering the
White Settlement system at the Shoreview Lift Station.
• Fort Worth will pay a one-time lump sum contribution to the cost of the construction of the Shoreview
Lift Station in the amount of $11,682. Fort Worth's capacity will be set at a monthly average of 35,000
gallons per day.
• Fort Worth will allow a volume credit and a transportation fee credit for Fort Worth flows entering the
White Settlement sewer system. The transportation fee will be based on Fort Worth's pro rata share of the
pumping and maintenance costs associated with the transportation of Fort Worth flows through the White
Settlement sewer system. The initial transportation fee credit is set at $.7532 per 1,000 gallons.
• White Settlement will agree to allow a temporary unmetered connection at the Shoreview Lift Station for
a period of 120 days to allow for the construction of the metering station. During the unmetered period Fort
Worth will allow wastewater billing credits of 10,500 gallons per resident and actual water used for
commercial establishments that have connected to the sewer system.
The Water Department believes that the conditions requested by White Settlement are fair and represent
the most cost effective option of serving Fort Worth customers in this area. Amendment No.1 to the White
Settlement Wholesale Wastewater Contract will incorporate the above conditions into the wholesale
wastewater contract.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that that this action will have no material effect on City funds.
