HomeMy WebLinkAboutContract 47997-A3 AMENDMENT No.3 Q c���S� TO CITY SECRETARY CONTRACT No. 47997 WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates L.P. , (ENGINEER) made and entered into City Secretary Contract No . 47997 , (the CONTRACT) which was administratively authorized by M&C 27806 on the 28 day of June, 2016 in the amount of $293, 763; and amended under City Secretary Contact No . 47997-A1, (the CONTRACT) which was authorized by M&C C-28398 on the 26 day of September, 2017 in the amount of $166, 910; and amended under City Secretary Contact No . 47997-A1, (the CONTRACT) which was authorized by M&C C-28773 on the 7th day of August, 2018 in the amount of $40, 000; WHEREAS, the CONTRACT involves engineering services for the following project : RANDOL MILL RD IMPROVEMENTS (INTERSTATE 820 TO PRECINCT LINE RD) ; and WHEREAS, it has become necessary to execute Amendment No . 3 to the CONTRACT to include an increased scope of work and revised fee; and WHEREAS, an error was made to Section 2 of Amendment No . 1, which will be corrected in this Amendment No . 2 ; NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT : 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 22, 2018, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $27, 000. 00. (See Attached Funding Breakdown Sheet, Page -3-) . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount up to $527, 673 . 00. Dunaway will provide thefollowing: SCOPE OF SERVICES The scope set forth herein defines the work to be performed by the ENGINEER in completing the project. Both the CITY and ENGINEER have clearly defined the work to be performed and address the needs of the Project according to objectives listed below: WORK TO BE PERFORMED Task 1. Project Management Task 2. Final Design 100% TASK 1. PROJECT MANAGEMENT ENGINEER will manage the work outlined in this scope to ensure efficient and effective use of ENGINEER's and CITY's time and resources. ENGINEER will manage change, communicate effectively, coordinate internally and externally as needed, and proactively address issues with the CITY's Project Manager and others as necessary to make progress on the work. Anticipated project timeline is 10 months (remaining design and construction). 1.1. Managing the Team Lead, manage and direct design team activities. • Task and allocate team resources. • Communicate internally among team members. • Ensure quality control is practiced in performance of the work. • Communicate directly with City on all design aspects. Communications and Reporting • Attend a pre-design coordination meeting with CITY. • Attend one (1) additional submittal review meeting with the CITY and with Stormwater Department staff. • Follow up PM correspondence with Stormwater Staff to gain their approval. ASSUMPTIONS • One (1) additional monthly project status report included. • One (1) additional submittal review meeting included with City staff. DELIVERABLES A. Monthly status reports (1 Total) B. Submittal Review meeting with minutes and action items TASK 2. FINAL DESIGN (100 PERCENT) Final plans and cost estimate shall be submitted to CITY per the approved Project Schedule. 2.1. Revision of Final Design Drawings shall include the following: • Revise Construction Plans to add proposed concrete drainage channel along south parkway of Randol Mill Rd per Stormwater comments. • Update bid quantities and prepare Change Order#1 to contractor. • Revise Supplemental Drainage Report for the Roundabout- Supplemental HEC RAS Drainage Model will be revised and analyzed for drainage system within the project limits as follows: • Evaluate drainage capacity for Roundabout and adjacent drainage ditches. Model height of water over Randol Mill Rd and affectsfrom upstream drainage crossing the road. • Update and re-submit Final Supplemental Drainage Study Report to City. • Revise Drainage Ditch Plan and Profiles at Roundabout. • Revise Storm Drain Plan and Profiles. Incorporate final hydraulics and design changes resulting from re-grading of ditches. • Add additional concrete channel design and details to the plans. ASSUMPTIONS • All storm water calculations shall conform to the 2015 CITY iSWM Criteria Manual for Site Development and Construction (iSWMM). All storm water design shall conform to iSWMM where possible, any deviations will be agreed upon between the CITY and the ENGINEER in writing and noted in the plans. • 3 sets of half-size and 2 sets of full-size plans will be delivered for the 100% design. • 5 sets of OPCC's will be delivered for the 100% design, and bid proposal revised. • DWF files and PDFs created from design CAD drawings will be uploaded to the designated project folder in Buzzsaw. • All submitted documents and checklists will be uploaded to the designated project folder in Buzzsaw. • Total of 20 revised plan sheets will be assumed for 100% submittal to Cityfor Change Order#1 package. DELIVERABLES A. Final Design Drawings for the Roundabout B. Final Revised Drainage Report for the Roundabout C. Change Order#1 package with revised bid proposal D. Authorize the execution of Amendment No. 3, in an amount of$27,000.00, to the Engineering S-wices Agreement with Dunaway Associates, L.P., City Secretary Contract No. 47997, for the additional design of Randol Mill Road at Precinct Line Road to provide pedestrian and drainage requirements for a revised contract amount of$527,673.00; and 2. Authorize the execution of Change Order No. 1 to City Secretary Contract No. 50812 with JLB Contracting, LLC, in the amount of$211,061.71 for Street Improvements on Randol Mill Road at Precinct Line Road, Phase 2, Intersection, thereby increasing the contract to an amount up to $1,364,818.42. DISCUSSION: Dunaway Associates Professional Engineering Agreement. On June 28, 2016, City Council approved Mayor and Council Communication (M&C C-27806) authorizing execution of an Engineering Services Agreement in the amount of$293,763.00 with Dunaway Associates, City Secretary Contract No. 47997, to provide complete design plans for these improvements. On September 26, 2017, City Council approved M&C C-28398 authorizing Amendment No. 1, in the amount of$166,910.00, for additional professional engineering design work and construction management services. On August 7, 2018, City Council approved M&C C-28773 authorizing Amendment 2, in the amount of $40,000.00 which provided for additional professional engineering services with scope changes regarding modifications to landscaping and pedestrian access to reduce long term maintenance costs and improve pedestrian safety. As the result of scope changes in Amendment 2, additional drainage improvements were required. Dunaway Associates proposes to perform these additional professional services in an amount not to exceed $27,000.00. On May 1, 2018, Mayor and Council Communication (M&C C-28649) the City Council authorized a contract with JLB Contracting, LLC, in the amount of $1,153,756.71 for Street Improvements on Randol Mill Road at Precinct Line Road, Phase 2, Roundabout Intersection. This Change Order No. 1, in the amount of$211,061.71, includes the addition of sidewalks, curb ramps, crosswalks, signage and pavement striping as well as modifications to drainage facilities to accommodate these improvements. These additional improvements were added to provide pedestrian crossings at each approach of the intersection and improved pedestrian movement around the intersections. JLB Contracting has delayed commencement of the project until the final design modifications were completed and this change order issued. The project will begin construction in November 2018 and is expected to be completed in November 2019. A portion of this project will use 2014 Bond Funds. Available resources within the General Fund will be used to provide interim financing for these expenses until debt is issued. Once debt associated with this project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official intent to reimburse, that was adopted as part of the ordinance canvassing the bond election (Ordinance no. 21241-05-2014) and subsequent actions taken by the Mayor and City Council. M/WBE OFFICE - JLB Contracting, LLC agrees to maintain its initial MBE commitment of 23% that it made on the original contract and extend and maintain that same MBE commitment of 23% to this first change order. Therefore JLB Contracting, LLC remains in compliance with the City's BDE Ordinance and attests to its commitment by its signature on the Acceptance of Previous MBE Commitment form executed by an authorized representative of its company. The project is located in COUNCIL DISTRICT 5. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget as appropriated, of the 2014 Bond Program Fund.
