HomeMy WebLinkAboutOrdinance 19589-03-2011Ordinance No. 19589-03-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $233,333.03, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF PROVIDING FUNDING FOR THE CITY'S ENERGY SAVINGS PERFORMANCE CONTRACT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $233,333.03, from available funds, for the purpose of providing funding for the City's Energy Savings Performance Contract. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Trust Fund by $233,333.03 to provide funding for the City's Energy Savings Performance Contract with Johnson Controls, Inc. DISCUSSION: On January 25, 2011, M&C G-17179 authorized Appropriation Ordinance No. 19520-01-2011 to effectively provide some of the necessary contingency funding for Energy Savings Performance Contract (ESPC) Phase VI-b. This funding was provided through the City's successful participation in ONCOR Electric Delivery's (ONCOR) commercial Standard Offer Program (SOP), after having received utility incentives both directly from ONCOR, and through Johnson Controls, Inc. (JCI), aCity-contracted Energy Services Company (ESCo). On January 25, 2011, M&C C-24718 also authorized Amendment No. 7 to City Secretary Contract (CSC) No. 29110 with JCI for the ESPC Phase VI-b. This Energy Conservation Program project is largely funded through the City's federal Energy Efficiency and Conservation Block Grant (EECBG) award (M&C C-23554, CSC No. 39311). An additional appropriation of $183,600.03 is necessary for contingency funds in order to fully implement the EECBG program initiatives of ESPC Phase VI-b. The additional appropriation will bring the total amount available for contingencies to this ESPC phase to $308,600.03, or 10 percent of the $3,085,591.00 approved project cost. This contingency amount is deemed appropriate given that the project involves the installation of new high-technology systems and equipment (e.g. Solar Energy and LED Lighting) as new to existing City facilities. On January 18, 2011, an ONCOR SOP incentive totaling $233,333.03 was deposited into the Conservation Reserve Account. In 2008, this account was established within the City's Special Trust Fund to receive utility incentives secured through implementing Energy Conservation Program projects. This utility incentive was received by the City from JCI after their having acted as the City's agent (ONCOR's Program Sponsor) in implementing the City's ESPC Phase IV project (M&C C-22868, CSC No. 37266).
