WHEREAS, The City of Fort Worth ("City") and GSBS Batenhorst, Inc. ("Architect")
made and entered into City Secretary Contract No. 47353 (the Contract) which was
authorized by the City Council by M&C C-27564, the 15th day of December, 2015, for
Eugene McCray Community Center Expansion & Hand ley-Meadowbrook Community
Center Expansion; and Amendments No. 1, 2, 3 & 4 were administratively executed in
the total amount of $79,756.00 to perform the Hand ley-Meadowbrook plat submittal's
iSWM report, to revise approved schematic design plans, to revise previously approved
parking layouts for both Community Centers, to modify civil & architectural construction
plans including a written narrative of the parking changes to the City of Fort Worth plans
examiner, respectively; and
WHEREAS, further amendment is necessary to reimburse the Architect as part of the
design services agreement for additional structural engineering design services to
repair existing structural construction deficiencies in the existing restroom area's
concrete floor slab at Eugene McCray Community Center.
NOW THEREFORE, City and Architect, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I, (6) — Scope of Services, a paragraph shall be added to read as follows:
Provide additional design services to repair existing structural floor slab
construction at the Eugene McCray Community Center. The cost of this
additional structural engineering service is $3,750.00 with no additional
reimbursable expenses. The scope of services is described more fully in the
GSBS's letter, Attachment "J" dated October 9, 2018, subject: "Re: Eugene
McCray Community Center".

Article II, (1) — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "J". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "J". However the total fee paid by the City shall not
exceed a total of $266,206.00 which includes $10,000.00 for reimbursable
expenses, unless the City and the Consultant mutually agree upon a fee amount
for additional services and amend this Agreement accordingly.

All other provisions of this Contract which are not expressly amended herein shall
remain in full force and effect.

Dear Alfonso,
Pursuant to the Contract executed for the "CITY OF FORT WORTH, TEXAS AGREEMENT FOR
ARCHITECTURAL SERVICES COMMUNITY ENTERS EXPANSION PROJECT" dated 12/15/15,
the following additional services proposal is presented for your review and consideration for
Professional Services as described below. The following is a summary of the change of work
as broken down on the Scope of Services Worksheets as provided.
Scope of Work (the Work): We understand the scope of the required additional services to be
repair of the existing slab-on-void within the original building due to additional trenching for
underground plumbing. It is our understanding that there was a leak in the plumbing line and
approximately 63'-0" of slab in the north-south direction was removed. Additional finishes and
coordination of the project are required for room 108, Women. The scope of our services is to
review and document the field conditions and develop repair drawings for replacement of the
structural slab. Also, one additional engineering site observation to review the repairs prior to
placing concrete.

Compensation:
We propose to complete the Scope of Work Changes to the Eugene McCray Community
Center described above for a stipulated sum for Basic Services of:
Item 1- Architectural Services: $750
Architect 2 3 hrs @ $145= $435
Architectural Technician 3 4 hrs @ $65= $260
Office Technician 1 1 hr @ $55= $55
Item 2- Engineering services: Lump Sum with estimated hours below $3,000
Senior Project Manager 2 hrs @ $175.00/HR = $350
Project Engineer 16 hrs @ $120.00/HR = $1,920
Senior Technician 8 hrs @ $90.00/HR = $720
Total $3,750
If additional services are required by the Owner the Architect will provide a written proposal
for approval and authorization in writing by the Owner to proceed with such work.
