AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
EXCESS RIGHT OF WAY OF CRESTLINE ROAD, SITUATED IN THE
JOHN KINDER SURVEY, ABSTRACT NO. 893 AND THE GEORDGE
KINDER SURVEY, ABSTRACT NO. 894, BEING PART OF ARLINGTON
HEIGHTS ADDITION, AN ADDITION OF THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 63, PAGE 21
OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND
CONTAINING APPROXIMATELY 979 SQUARE FEET OF LAND,
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an excess portion of Crestline Road right-of-way, according to the Plat of Chamberlin
Heights, Fort Worth, Texas, recorded in Volume 63, Page 21 of the Plat Records of Tarrant
County, Texas, and containing 979 square feet of land, and as more specifically described in
Exhibits "A" and `B" attached hereto and incorporated herein by reference, be and the same is
vacated and extinguished.
SECTION 2.
That the fee to the,land in the above-described street right-of-way is released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a portion of Crestline Road, a 100ft wide right-of-way, according to the Plat of
Chamberlin Arlington Heights, Fort Worth, Tarrant County, Texas, recorded in Volume
63, Page 21 of the Plat Records of Tarrant County, Texas (PRTC) and adjoining a
portion of a 1.53 acre tract being a portion of Lot 1 and Lot 28, Block C, of the said
Chamberlin Arlington Heights and the John Kinder Survey Abstract No 893 and the
George Kinder Survey Abstract No, 894 Fort Worth, Tarrant County, Texas, said 1.53
acre tract being described in the Deed to Crestline Property Holdings, LLC, recorded in
D217172867 of the Deed Records of Tarrant County, Texas (DRTC) said tract being
tied to the Texas Coordinate System, North Central Zone, NAD83 using RTK Surveying
methods tied to the SmartNet Network reference station no. 2312, bearings are grid,
distances are horizontal ground measurements, said tract being more particularly
described as follows:
BEGINNING a found 1" spike for the southeast corner of the said 1.53 acre tract and
also being the southwest corner of Lot B, Block B Chamberlin Arlington Heights, Fort
Worth Tarrant County, Texas according to the Plat recorded in Volume 388-Z, Page 61
PRTC, said point being in the north right-of-way of the said Crestline Road;
THENCE S7°03'02"E 17.03ft;
THENCE S41 °22'44"W, 116.18ft to the southeast corner of the said Lot 28, from which
a found "Y" cut in the top of a brick column bears, S43057'38"W, 78.00ft;

SUBJECT:
Adopt Ordinance Vacating a Portion of Right -of -Way Along Crestline Road to be Replatted with the
Adjoining Property to Remove an Encroachment of an Existing Wall (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of right-of-way along Crestline Road to be replatted
with the adjoining property to remove an encroachment of an existing wall; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
J.B. Davies Inc., on behalf of Crestline Property Holdings LLC, has requested vacation of this portion of
Crestline Road to be replatted with the adjoining property to remove encroachment of an existing
wall. The City Plan Commission recommended approval of this request at its meeting on October 24,
2018. An acceptable final plat (FS -18-229) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat
dedication. The City does not own any fee interest in the right-of-way or own any property adjacent to the
right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the fair
market value or any portion thereof of purchase price of this right-of-way easement for the street.
This project is located in COUNCIL DISTRICT 7.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds. Any assets recorded on the City's financial statements associated with this land will be
adjusted upon approval.
