COUNTY OF TARR.ANT
WHEREAS, the City of Fort Worth (City) and Dunaway Associates, L.P., (Engineer)
made and entered into City Secretary Contract No. 34093, (the Contract) which was
authorized by the City Council by M&C C-21712 on the 26�h day of September 2006; and
WHEREAS, the Contract involves engineering services for the following project:
Engineering Design Services: Street Reconstruction, Storm Drain Design on College
Avenue (Page St. to W. Capps St.), Orange Street (Stanley Avenue to Townsend
Dr.), Lipscomb Street (W. Capps St. to W. Berry St.) and Wayside Avenue (N. Dead
End to W. Cantey St.), 2004 CIP Year 4& 5, Contract 53, Project No. 00455; DOE

WHEREAS, it has become necessary to execute Amendment No. 5 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly-
authorized representatives, enter into the following agreement which amends the
Contract:
1.
Article I of the Contract is amended to include the additional engineering services
as specified in a proposal letter dated April 28th, 2009 a copy of which is attached hereto
and incorporated herein. The cost to City for the additional services to be performed by
Engineer total $8,000.00.
2.
Article II of the Contract is amended to provide for an increase in the maximum fee to be
paid to Engineer for all work and services performed under the Contract, as amended, so
that the total fee paid by the City for all work and services shall not exceed the sum of
$208,357 + $15,510 (Amendment No.l) + $4,440 (Amendment No. 2) + $10,570
(Amendment No. 3) + $24,750 (Amendment No. 4) + $8,000 = $ 271,627.

All other provisions of the Contract, which are not expressly amended herein, shall
remain in full force and effect.

Dear Ms. Johnson:
Dunaway Associates, L.P. is pieased to present ihis Amendment No, 5 for additional
engineering design services requested by the City that are beyond our original scope of
services, The general scope ofithese additional services is asfollows.
Task 1— Median Barrier @ BNSF RR ROW an Lipscomb Street
City sfaff requested the design of a raised median to deter cars from driving around the
lowered RR gates. Based on the alignment from the Lipscomb Street reconstruction set,
the raised median would be 18" to 24° wide and have the following limits:
• STA 22+90 Co STA 23+40
. STA 24+50 to STA 24+80
An R4-7 sign would be placed at the northernmost and southernmost points of the
medians.
This reque5t is for the efFort involved in preparation of details for the new raised median,
modification of the RR Exhibif A, and production of revised roadway plan/profile sheets and
cross-sections.
Task 2� Redesign of College Street East Curbline
During the course of construction, property owners along the east side of College Street
requested modifications in the alignment of the east curb line to provide additional clearanee
between the back of curb and existing trees in the parkway.

This request is for the additional etfort involved in realignment of the curbline, redesign of
cross-sections, and production of revised plan and section sheets.
