(Architect), made and entered into City Secretary Contract No. 34101 (The Contract) which was authorized by the City Council by M&C C- 21667, the 12th day of September, 2006; and WHEREAS further amendment is necessary to increase the total fees for the annual architectural design agreement over the five-year period of the agreement; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Paragraph 4.1 of SECTION IV - COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the Project assignments to be performed by Architect as �escr�beu in Section {! � CH,4RACTER AN� EXTENT of ARCHlTECT'S SERVlCES hereof shal! not exceed $900,000.00 (the "Contract Limits"), unless modified by an amendment hereto authorized in writing by the parties." 2. Paragraph 9.1 of SECTION IX - TERM & TERMINATION, is amended as follows: "This Agreement shall commence on the date of its execution by both parties and remain in effect for five (5) years or until the expenditure of $900,000.00 (the "Contract Limits"), which ever occurs first. Provided however, the term and/or Contract Limits may be extended by an executed written amendment authorized by the parties." Qn November 27, 2007, (M&C C-22527) the City Council aufihorized the Cify Manager to execute Amendment No. 1 fo City Secretary Contract No. 34101 with Elements of Architecture, Inc., to increase the total fee to not-to-exceed $600,000.00 over the fhree-year period of the agreement. Due to the large number of small, renovation and expansion projects, Elements of Archifecture, (nc., has approximately S7 Delivery Orders (including amendments) at:an estimated cost of $560,000.00 at various stages of completion, under construction, design and programming. The City of Fort Worth will continue to require architectural assistance for small multi-disciplinary projects on an as-needed- basis. Elements of Architecture, Inc., is assisting City staff to respond fo the numerous requirements for the design of small renovation and expansion projects that require the assistance of civil, landscaping, structural, mechanical and electrical consultants in preparing programming, schematics design and construction documents. The architectural firm is also assisting staff with structural, mechanical and electrical assessments; cost estimating; office space needs evaluations; conceptual site and floor plans for review; and designs for emergency repairs of damaged facilities. Elemenfs of Architecture, Inc., has provided excellent service during the first three years of this agreement. City staff recommends extending the term ofi this agreement from three to five years to provide continuity of service. All expenditures for the project assignments will be made through allocations from capital and departmental budgets. Elements of Architecture, Inc., is in compliance with the City's M/WBE Ordinance by commiffiing to 20 percent M/V1/BE participation for this agreement. The City's M/WBE goal for this agreement is 20 percent.
