Moss Land Development Company, hereinafter called "Developer", desires to make certain improvements to Willow Springs Ranch, an addition to the City of Fort Worth, Tarrant County, Texas; and WHEREAS, the said Developer has requested the City of Fort Worth, a municipal corporation of Tarrant, Wise, and Denton Counties, Texas, hereinafter called "City", to do certain work in connection with said improvements. NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: That said Developer, acting herein by and through Danny Moss, its duly authorized President, and the City, acting herein by and through Marc Ott, its duly authorized Assistant City Manager, for and in consideration of the covenants and conditions contained herein, do hereby agree as follows: I. General Requirements A. The Policy for the Installation of Community Facilities ("Policy") dated : C� � E March 2001, subsequently amended and approved by the City Council of the City of Fort Worth, is hereby incorporated into this Community Facilities Contract as if copied herein verbatim. Except as noted herein, Developer agrees to comply with all provisions of said Policy in the performance of its duties and obligations hereunder. The requirements of the Policy shall govern this Community Facilities Agreement, provided, however, that any conflict between the terms of this Community Facilities Agreement and the Policy shall be resolved in favor of this Agreement. Developer shall provide financial security in conformance with paragraph 6(B) (1) (a), Section II, of the Policy. The Developer shall award all contracts far the construction of community facilities in accordance with Section II, paragraph 7(a) of the Policy. F. The Developer further covenants and agrees to, and by these presents does hereby, fully indemnify, hold harmless and defend the City, its officers, agents and employees from all suits, actions or claims of any character, whether real or asserted, brought for or on account of any injuries or damages sustained by any persons (including death) or to any property, resulting from or in connection with the construction, design, performance or completion of any work to be performed by said Developer, his contractors, subcontractors, officers, agents or employees, or in consequence of any failure to properly safeguard the work, or on account of any act, intentional or otherwise, neglect or misconduct of said DEVELOPER, his contractors, sub-contractors, officers, agents or employees, fvlzether or not sasclz i�iiuries, deatlz or dafrza,�es are cacisecl, i�t fvlzole or i�i part, bv tlze alle�ed �ae�li,�e�ice of tlie Citv of Fort Wortlt, its officers, serva�ats, or eniploVees. G. Developer shall install or adjust all of the required utilities to serve the development or to construct the improvements required herein. H. Developer hereby releases and agrees to indemnify and hold the City harmless for any inadequacies in the preliminary plans, specifications and cost estimates supplied by the Developer for this Agreement. I. Developer agrees to provide, at its expense, all necessary rights of way and easements across property owned by Developer required to construct current and future improvements provided for in this agreement. J. Developer agrees to construct proposed improvements as shown on the exhibits attached hereto. The following exhibits are made a part hereof: Water (A) attached. K. Water Facilities A. Developer shall install the proposed water line(s), fire line(s) and/or meters as shown on Exhibit A, the estimated cost of which is $$560,787, including construction inspection fees of $10,784 and materials testing fees of $10,784. The City agrees to record the location of each said service line in respect to the corner of the lot served, and to retain said records in its possession. B. City shall reimburse Developer 100% of the cost, including construction inspection and materials testing fees, of the water system improvements in two installments. City will reimburse Developer 40% of the cost of the water system improvements when the City inspector determines that the improvements are 50% complete. City will reimburse Developer the remaining 60% of the cost of the water system improvements when the City inspector determines that the improvements are complete; have been tested, and officially accepted by the City. The City will be reimbursed for the cost of the water system improvements through a pro rata connection fee ardinance, which will apportion the cost of the water system improvements (estimated at $560,787.00) among the 96 lots in the subdivision that will connect to the water system. The 42 subdivision lots located in the county will not connect to the water system. Therefore, the estimated pro rata connection fee is $5,841.53 per lot. The pro rata connection fee will be due when an individual requests a building permit or connection to the water system, whichever occurs later. No vertical construction will be permitted until the Developer satisfies the requirements of Construction and Fire Prevention Board Variance Case No. 06-26. Said Variance includes, but is not limited to the following requirements: Phase One — Building Permit Application / Plan Review • Upon approval of the variances requested by the Developer by City's Construction and Fire Prevention Board, the City's Development Department will accept applications and release "foundation only" building permits. • All permit applications for vertical construction will be placed on hold until acceptable plans for the public infrastructure under this agreement are submitted by the Developer and approved by the City's Water Department and the conditions of Phase Two below are met. Moss Land Development Company for Construction of Water Services to Serve Willow Springs Ranch in the Far Northwest Portion of the City of Fort Worth and Adoption of Pro-Rata Connection Fee Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to execute a Community Facilities Agreement with D.R. Moss Land Development Company, for the installation of water services to serve �Ilow Springs Ranch, located in far northwest Fort Worth; and 2. Adopt the attached Pro-Rata Connection Fee Ordinance to provide the City reimbursement for cost of the water system improvements, including construction inspection and material testing fees. DISCUSSION: D.R. Moss Land Development Company has executed a proposed contract for community facilities to serve a single-family development located in the far northwest portion of Fort Worth, south of Avondale- Haslet Road and west of Willow Springs Road (see attached map). This subdivision has annexed into the City of Fort Worth on November 8, 2005 (AX02-009) Ordinance No. 16704, where 96 lots are now in the City and 42 lots remained in Tarrant County. The 42 subdivision lots located in the County will not connect to the water system. The total cost for water improvements for this development is $560,786.00, including construction inspection and material testing fees. The developer will pay for the water system improvements and be reimbursed by the City as follows: forty percent of the cost will be reimbursed upon completion of 50 percent of the water system improvements and the remaining sixty percent of the cost will be reimbursed upon completion inspection and acceptance of the water system improvements. The City will be reimbursed for the cost of the water system improvements through the pro-rata connection fee ordinance. The pro-rata connection fee ordinance will apportion the cost of the water system improvements among the 96 lots in the subdivision that will connect to the water system, which is equal to $5,841.53 per lot, and will be collected at the later of the issuance of a building permit or the connection to the water system. The City will be responsible for the filing of the ordinance in the Tarrant County Deed Records.
