AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
GENDY STREET, BURNETT TANDY DRIVE, RIP JOHNSON DRIVE,
W.R. WATT DRIVE, CLYDE STREET, SENECA STREET, WINONA
STREET AND VARIOUS ALLEY RIGHTS -OF -WAY SITUATED IN THE
THOMAS WHITE SURVEY, ABSTRACT NOS. 70 AND 1636, TARRANT
COUNTY, TEXAS AND THE J.P. MONTGOMERY SURVEY,
ABSTRACT NO. 1030, TARRANTY COUNTY, TEXAS, IN THE CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN
VOLUME 310, PAGE 32 AND CABINENT A, SLIDES 2153 AND 8180 OF
PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF
EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following portions of the streets described below:
1. A 0.415 acre tract of land out of the Thomas White Survey, Abstract No. 70,
Tarrant County, Texas and being a portion of Gendy streets (a remainder
variable width right-of-way) as shown on plat of Ross Heights, an addition to
the City of Fort Worth, Tarrant County, Texas, said portion of Gendy Street
also shown on plat of Gendy Street and Burnett Tandy Drive as recorded in
Cabinet A, Slide 8180 of said Plat Records of Tarrant County, Texas;;
2. A 2.455 acre tract of land out of the Thomas White Survey, Abstract No. 70,
Tarrant County, Texas and being all of the alleys in Block 2, Block 3, Block 4
and Block 5 of Ross Heights, an addition to the City of Fort Worth, as
recorded in Volume 310, Page 32 of the Plat Records of Tarrant County,
Texas, said 2.455 acre tract of land also being all of Clyde Street between said
Blocks 2 and 3 of said Ross Heights and portion of Clyde Street between
Block 4 and 5 of said Ross Heights and the portion of Winona Street adjacent
to the north lines of Block 2 and Block 3 of said Ross Heights;
3. A 2.007 acre tract of land out of the Thomas White Survey, Abstract No.
1636, Tarrant County, Texas and the J.P. Montgomery Survey, Abstract No.
1030, Tarrant County, Texas, said 2.007 acre tract of land being all of Rip
Johnson Road, Burnett -Tandy Drive and W.R. Watt Drive as shown on the

Plant of Will Rogers Memorial Center, an addition to the City of Fort Worth,
Tarrant County, Texas as recorded in Cabinet A, Slide 2153 of the Plat
Records of Tarrant County.
and as more specifically described in Exhibits "A" "B" "C" and "D" attached hereto and
incorporated herein, by reference be and the same are vacated and extinguished.
SECTION 2.
That the fee to the lands in the above -described vacated alleys and streets are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

TRACT I
BEING a 0.415 acre tract of land out of the Thomas White Survey, Abstract No. 70, Tarrant
County, Texas and being a portion of Gendy Street (a remainder variable width right-of-way) as
shown on plat of Ross Heights, an addition to the City of Fort Worth, Tarrant County, Texas as
recorded in Volume 310, Page 32 of the Plat Records of Tarrant County, Texas, said portion of
Gendy Street also shown on nlat of Gendv Street and Burnett Tandy Drive as recorded in Cabinet
A, Slide 8180 of said Plat Records of Tarrant County, Texas, said 0.415 acre tract of land being
more particularly described by metes and bounds as follows:
BEGINNING at a "X" cut in concrete found for the most easterly southeast corner of said
Gendy Street (Cabinet A, Slide 8180), said "X" cut in concrete being the intersection of the
existing east right-of-way line of said Gendy Street (Cabinet A, Slide 8180) and the proposed
north right-of-way line of Harley Avenue (a variable width right-of-way);
THENCE North 44 degrees 40 minutes 46 seconds West, with the existing east right-of-way line
of said Gendy Street (Cabinet A, Slide 8180), a distance of 28.30 feet to a "X" cut in
concrete found for corner;
THENCE North 00 degrees 17 minutes 17 seconds East, with the existing east right-of-way line
of said Gendy Street (Cabinet A, Slide 8180) a distance of 443.73 feet to a 5/8 inch
iron rod with cap stamped "C&B" found for the beginning of a curve to the right
having a radius of 15.00 feet, a central angle of 60 degrees 46 minutes 18 seconds and
whose chord bears North 30 degrees 41 minutes 22 seconds East, a distance of 15.17
feet;
THENCE with said curve to the right and the east right-of-way line of said Gendy Street
(Cabinet A, Slide 8180), an arc length of 15.91 feet to a 5/8 inch iron rod with cap
stamped "C&B" found at the beginning of a reverse curve to the left having a radius
of 112.00 feet, a central angle of 16 degrees 55 minutes 44 seconds and whose chord
bears North 52 degrees 36 minutes 39 seconds East, a distance of 32.97 feet;
THENCE with said reverse curve to the left and the east right-of-way line of said Gendy Street

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating Burnett Tandy Drive, Rip Johnson Drive, W.R. Watt Drive, Clyde
Street, Seneca Street, Winona Street and alleys and a portion of Gendy Street within the Will Rogers
Memorial Center; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G-
15624).
DISCUSSION:
The City of Fort Worth, has requested the vacation of the above referenced rights -of -way to replat the
right-of-way with the adjoining City property to allow for building and drive expansion as well as to secure
the site for City events. The City Plan Commission recommended approval of these requests at its
meetings on September 22, 2010 and on November 9, 2010. An acceptable replat (FS-010-111) has been
received. Any existing utilities will be relocated at the City's expense or retained within a designated
easement, along with an appropriate plat note that no permanent structures may be constructed or placed
thereon.
Upon vacation, the right-of-way will remain in the City ownership and will be used for the public purposes
associated with the Will Rogers Memorial Complex.
This land is located in COUNCIL DISTRICT 7.

The Financial Management Services Director certifies that this action will have no material effect on City
funds.
