HomeMy WebLinkAboutOrdinance 19661-04-2011Ordinance No.19661-04-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $379,975.00, SUBJECT TO RECEIPT OF A 2010 BUFFER ZONE PROTECTION PROGRAM GRANT FROM THE TEXAS DEPARTMENT OF PUBLIC SAFETY, FOR THE PURPOSE OF REDUCING CRITICAL INFRASTRUCTURE AND KEY RESOURCE SITE VULNERABILITIES AND SUPPORTING THE PREVENTION AND PREPAREDNESS EFFORTS OF LOCAL LAW ENFORCEMENT FIRST RESPONDERS RELATED TO TERRORIST ACTS POTENTIALLY IMPACTING THESE SITES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various Ciry departments for Fiscal Year 2010-2011 in the Budget of the Ciry Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $379,975.00, from available funds, for the purpose of reducing critical infrastructure and key resource site vulnerabilities; and supporting the prevention and preparedness efforts of local law enforcement first responders related to terrorists acts potentially impacting these sites. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to ratify the application fora 2010 Buffer Zone Protection Program Grant from the Texas Department of Public Safety in the amount of $379,975.00; 2. Authorize the City Manager to execute a contract with the Texas Department of Public Safety in connection with the acceptance of the grant; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $379,975.00, subject to receipt of the grant. DISCUSSION: The Buffer Zone Protection Program (BZP Program) Grant originates from the Department of Homeland Security and is administered through the Texas Department of Public Safety. The BZP Program grant provides funds to support the implementation of Buffer Zone Protection Plans (BZP Plan) for identified critical infrastructure/key resource sites. The Fort Worth Police Department's Intelligence Unit has developed a BZP Plan in coordination with the State Administrative Agency (SAA) and Homeland Security Advisor (HSA). To implement the BZP Plan, funds have been requested under the BZP Program to (a) reduce critical infrastructure and key resource site vulnerabilities; and (b) support the prevention and preparedness efforts of local law enforcement first responders related to terrorists acts potentially impacting these sites. This particular BZP Plan is eligible for $379,975.00 in grant funds. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon the approval of the above recommendations, receipt of the grant, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
