HomeMy WebLinkAboutOrdinance 19665-04-2011Ordinance No.19665-04-2411 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TRANSPORTATION IMPACT FUND IN THE AMOUNT OF X728,312.75, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE ACQUISITION OF LAND FOR RIGHT-OF-WAY AND AN EASEMENT INTEREST ON TIMERLAND BOULEVARD AND ALTA VISTA BOULEVARD; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also Lae increased estimated receipts and appropriations in the Transportation Impact Fund in the amount of $728,312.75, from available funds, for the purpose funding the acquisition of land for aright-of-way and an easement interest on Timberland Boulevard and Alta Vista Boulevard. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager or his designee to accept the conveyance, record the appropriate instruments and pay closing costs up to $11,000.00; 2. Authorize the acquisition of a fee simple interest in approximately 4.639 acres of land for right-of-way and an easement interest in 0.535 acres for a temporary construction easement located on Timberland Boulevard and Alta Vista Boulevard, from North Tarrant 226 Joint Venture; 3. Find that the price of $959,500.00 is just compensation; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the amount of $728,312.75 in the Transportation Impact Fee Fund from available funds. DISCUSSION: The 2008 Bond Program included funds for North Beach Street from Keller Nicks to just North of Timberland Boulevard which will fund a portion of this right-of-way purchase. Additional funding from the Transportation Impact Fee Fund will be utiltized for the portion of right-of-way needed along Timberland Boulevard. ~ ~ .. ~ _ , 1 F ~ ~ ~; 7 ~ ~ ~, . ~ ~, _. ~ , r ~. ., ~.
