HomeMy WebLinkAboutContract 34221STATE OF TEXAS § COUNTY OF TRAVIS § CSJ # 0902-48-683 District # 02 Code Chart 64 # 15000 Project: Urban Village (Southwest Cluster) LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT For a Demonstration Project (Off State System) THIS Local Project Advance Funding Agreement (LPAFA) is made by and between the State of Texas, acting by and through the Texas Department of Transportation, hereinafter called the "State", and the Citv of Fort Worth, acting by and through its duly authorized officials, hereinafter called the "Local Government." WITNESSETH WHEREAS a Master Agreement between the Local Government and the State has been adopted and states the general terms and conditions for transportation projects developed through this LPAFA; and, WHEREAS the Texas Transportation Commission passed Minute Order 108410 that provides for the development of, and funding for, the project described herein; and, WHEREAS the Governing Body of the Local Government has approved entering into this LPAFA by city council action, dated January 19, 2006, which is attached hereto and made a part hereof as Attachment A for development of the specific project which is identified in the location map shown as Attachment B. NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto, to be by them respectively kept and performed as hereinafter set forth, it is agreed as follows: AGREEMENT 1. The period of this LPAFA is as stated in the Master Agreement, without exception. 2. Termination of this LPAFA shall be under the conditions as stated in the Master Agreement, without exception. 3. Amendments to this LPAFA shall be made as described in the Master Agreement, without exception. 4. Scope of Work: Southwest Cluster The scope of work for this LPAFA is described as follows: There will be four (4) different projects developed under this agreement. The locations of these are shown on Attachment B (Berry/University, Bluebonnet Circle, Ridglea and Hemphill/Berry). AFA—LPAFA_OffSys Page 1 of 15 Revised 2/2/06 CSJ # 0902-48-683 District # 02 Code Chart 64 # 15000 Project: Urban Villaqe (Southwest Cluster) All four (4) projects will consist of a planning phase (Berry/University, Bluebonnet Circle, Ridglea and Hemphill/Berry) and one (1) of the projects (Hemphill/Berry) will have a design and construction phase. Phase One - Planning The following tasks shall be completed for each of the five projects during the planning phase: Public Involvement • Project Kickoff Meeting: The Local Government will work with the selected Consultant to plan, coordinate, participate and execute a Project Kickoff Meeting. This meeting will allow the project Consultant to learn about stakeholders' input and desires. Three (3) Stakeholder Meetings: The Local Government will work with the selected Consultant to plan, coordinate, participate and execute approximately three (3) stakeholders meetings. The Local Government will update the stakeholders on the progress of the project. Project Context/Previous Planning Documents • The Local Government will require the selected Consultant to tour the four (4) locations (Berry/University, Bluebonnet Circle, Ridglea and Hemphill/Berry). • The Local Government will require the selected Consultant to review all planning documents and materials including but not limited to: the latest version of the City Comprehensive Plan, any previous study of each project location, and any related development regulations concerning each project. Urban Village Inventory and Analysis • The Local Government will provide the selected Consultant with any available aerial photographs, utility maps, block maps, zoning maps, water and sewer utility maps. In turn, the selected Consultant will prepare an inventory and analysis report for each project location (Berry/University, Bluebonnet Circle, Ridglea and Hemphill/Berry). Development Opportunities • The Local Government will require the selected Consultant to develop a concept plan of suggested land uses for vacant and underutilized properties. This concept plan must account for realistic market opportunities and constraints such as adequate space for parking. Transportation Needs and Priorities • The Local Government will require the selected Consultant to develop a transportation concept plan. This plan will identify the needs for transportation improvements like pedestrian, bicycle and vehicular modes for each project location. The following tasks shall be completed as determined by order of importance and as necessary for each,of the four (4) projects during the planning phase: Mixed -Use Zoning Boundaries • The selected Consultant will create mixed -use zoning maps showing defensible boundaries for each project location. • The Local Government will utilize necessary documents to obtain support among Stakeholders for each project location. Market Analysis • The selected Consultant will prepare the market analysis report for each project location. This study will include the market indicators and conditions that impact demand for land uses. This study will also identify financial/economic trends and forecasts for the proposed uses in the trade area over the next 5 to 10 years. Traffic Engineering • The selected Consultant will create base maps and recommend and describe/depict design modifications for each project location. Design Guidelines • The selected Consultant will provide design guidelines for the new development and redevelopment based on community input. Phase Two — Design, Engineering and Construction There will be one (1) Plans, Specifications, and Estimates (PS&E) package developed for Hemphill/Berry Urban Village. The activities to be included in this package are as follows: • Demolition of substandard curb and sidewalks within the project boundaries, as needed; • Reconstruction of streets, as necessary; • Repaving of streets and/or other paving enhancements, as necessary; • Construction of concrete sidewalk and curbs within the project boundaries, as needed; • Development of standard crosswalk(s) at intersection(s); • Installation of safety improvements, including traffic calming elements; • Striping and/or construction of crosswalk(s) with brick paver accents and possibly other detailing at intersection(s) within the project boundaries; • Construction of bulb -outs and/or provision for on -street parking, as necessary; • Installation of Americans with Disabilities Act (ADA) compliance improvements; AFA—LPAFA_OffSys Page 3 of 15 Revised 2/2/06 CSJ # 0902-48-683 District # 02 Code Chart 64 # 15000 Project: Urban Villaae (Southwest Cluster) • Installation of pedestrian improvements, including but not limited to new street and pedestrian lighting and wayfinding systems, benches, trash receptacles, and/or other enhancements to promote pedestrian activity within the project boundaries; • Installation of street signs, sign toppers, and banners for identification of neighborhoods and commercial areas; • Improvements to transit facilities, such as passenger shelters, stations, and transfer centers • Creation or construction of bicycle lanes, bicycle signage, bike lock facilities, or other bicycle facilities; • Landscaping, including but not limited to, street trees within the project boundaries; • Landscaped medians with appropriate breaks within the project boundaries, • Landscaping and installation of drainage and irrigation systems; • Location and relocation of electric utility lines underground, as necessary; and • Design and relocation of traffic signal and pedestrian signal controls, as necessary to meet the objectives of the project. 5. Right of Way and Real Property shall be the responsibility of the Local Government, as stated in the Master Agreement, without exception. 6. Adjustment of utilities will be provided by the Local Government as required and as stated in the Master Agreement without exception. 7. Environmental Assessment and Mitigation will be carried out as stated in the Master Agreement, without exception. 8. Compliance with Texas Accessibility Standards and ADA will be as stated in the Master Agreement, without exception. 9. Architectural and Engineering Services will be provided by the Local Government, as stated in the Master Agreement, without exception. The Local Government is responsible for performance of any required architectural or preliminary engineering work. The State may review and comment on the work as required to accomplish the public purposes of the State. The Local Government will cooperate fully with the State in accomplishing these local public purposes to the degree permitted by State and Federal law. The design criteria for the PS&E packages will conform to the State's Roadway Design Manual. The State will review and approve the design of the project. 10. Construction Responsibilities will be carried out by the Local Government, as stated in the Master Agreement, without exception. 11. Project Maintenance will be undertaken as provided for in the Master Agreement, without exception. Project Cost Estimate: A Project Cost Estimate is provided in Attachment C. Any work done prior to federal authorization will not be eligible for reimbursement. It is the Local Government's responsibility to verify with the State that the Federal Letter of Authority has been issued for the work covered by this Agreement. b. A Source of Funds estimate is also provided in Attachment C. Attachment C shows the percentage and absolute dollar amount to be contributed to the project by federal, state, and local sources. c. The Local Government is responsible for all non-federal and non -state funding, including all project cost overruns, unless provided for through amendment of this agreement. d. Not Applicable e. If any existing or future local ordinances, commissioners court orders, rules, policies, or other directives, including but not limited to outdoor advertising billboards and storm water drainage facility requirements, are more restrictive than State or Federal Regulations, or if any other locally proposed changes, including but not limited to plats or replats, result in increased costs, then any increased costs associated with the ordinances or changes will be paid by the local government. The cost of providing right of way acquired by the State shall mean the total expenses in acquiring the property interests either through negotiations or eminent domain proceedings, including but not limited to expenses related to relocation, removal, and adjustment of eligible utilities. h. The state auditor may conduct an audit or investigation of any entity receiving funds from the state directly under the contract or indirectly through a subcontract under the contract. Acceptance of funds directly under the contract or indirectly through a subcontract under this contract acts as acceptance of the authority of the state auditor, under the direction of the legislative audit committee, to conduct an audit or investigation in connection with those funds. An entity that is the subject of an audit or investigation must provide the state auditor with access to any information the state auditor considers relevant to the investigation or audit. 13. Document and Information Exchange. The Local Government agrees to electronically deliver to the State all general notes, specifications, contract provision requirements and related documentation in a Microsoft® Word or similar document. If requested by the State, the Local Government will use the State's document template. The Local Government shall also provide a detailed construction time estimate including types of activities and month in the format required by the State. This requirement applies whether the Local Government creates the documents with its own forces or by hiring a consultant or professional provider. 14. Incorporation of Master Agreement Provisions. This LPAFA incorporates all of the governing provisions of the Master Advance Funding Agreement (MAFA) in effect on the date of final execution of this LPAFA, unless such MAFA provision is specifically excepted herein. 15. Insurance. If this agreement authorizes the Local Government or its contractor to perform any work on State right of way, before beginning work the entity performing the work shall provide the State with a fully executed copy of the State's Form 1560 Certificate of Insurance verifying the existence of coverage in the amounts and types specified on the Certificate of Insurance for all persons and entities working on State right of way. If coverage is not maintained, all work on State right of way shall cease immediately, and the State may recover damages and all costs of completing the work. 16. Signatory Warranty. The signatories to this agreement warrant that each has the authority to enter into this agreement on behalf of the party represented. Federal Transportation Funds, Allocation of These Funds for Certain Designated Urban Villages, Authorize Execution of Funding; Agreements with TxDot, Adopt Appropriation Ordinance, and Authorize Nominating Projects for the North Central Texas Council of Governments- Sustainable Development Program RECOMMENDATION: It is recommended that the City Council. 1. Authorize the City Manager to accept FY 2004 and FY 2005 federal transportation funds in the total amount of $4,484,000,00 from the Federal Highway Administration; 2. Allocate these federal transportation funds for planning„ design and construction in designated urban villages as specified in Attachment A; 3. authorize the City Manager to execute funding agreements with the Texas Department of Transportation (TxDOT) for the specified urban village projects, and to remit payment for applicable administrative fees; 4. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $4,484,000.00; and 5. Authorize the City Manager to nominate projects for the North Central Texas Council of Governments (NCTCOG) Sustainable Development Program as specified in Attachment B_ In the FY 2004 and FY 2005 federal appropriations bills, the City of Fort Worth received earrna*s totaling $4,484,000.00 ("Urban 4"illage Funds") in transportation funds through the Federal Highway Administration's Section 115 Demonstration Program. These funds are to be allocated for projects within designated urban villages. In addition, NCTCOG issued a call for projects on October 17 to public agencies in order to fond up to approximately S40 million in transportation improvements throughout the region ("Sustainable Development Funde)_ NCTCOG has set aside $12.6 million of these funds for the Western subregion -- which includes the City of Fort Worth — for projects around transit stations; for pedestrian -oriented inflll projects in historic downtowns; and for infill projects in loan -income, high unemployment, and high vehicle emission areas. On November 1, 2005, the Central City Revitalization and Economic Development Committee (CCREDC) endorsed the release of a Request for Proposals (RFP) to allocate Urban Village Funds and to nominate projects for the NCTCOG Sustainable Development Funds_ In accordance with the CCREDC endorsement, the City issued an RFP on November 2„ 2005. An interdepartmental working group — comprised of staff from Planning, Transportation and Public Works, Economic and Community Development, Parks and Community Services, Engineering, and the T — reviewed, evaluated:, and rated each of the proposals.. On December 23, 2005, the City Plan Commission (CPC) reviewed the staff evaluations and recommended funding five urban villages for planning, design and construction; and funding another semen urban villages for planning only, as specified in Attachment A. The CPC also recommended the nomination of seven projects for Sustainable Development funding as specified in Attachment B. The City Council received a briefing on these recommendations on January 10, 2006. Upon approval of this M&sC, staff will complete the following activities., Urban Village Projects . work with community stakeholders to select consultants for planning and design. . Mork with TxDOT- to execute appropriate funding agreements_ (Staff estimates that TxDOT's administrative fees for these funding agreements will represent approximately eight percent of prgiect costs.) . Request City Council authorization to execute planning and design contracts. Sustainable Development Proiects e Submit nominations to NCTCOG on Friday, January 20, 20GG. e Report to the City Council the project selections made by the Regional Transportation Council on April 13, 20G6. Work with NCTCOG to execute appropriate funding agreements. These projects are located in Council Districts 2, 3, 41, 5, 7, 8, and 9. Authorize the City Manager to accept FY 2004 and FY 2005 federal transportation funds in the total amount of $4,484,000.00 from the Federal Highway Administration; 2. Allocate these federal transportation funds for planning, design and construction in designated urban villages as specified in Attachment A; 3. Authorize the City Manager to execute funding agreements with the Texas Department of Transportation (TxDOT) for the specified urban village projects, and to remit payment for applicable administrative fees; 4. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $4,484,000.00; and 5. Authorize the City Manager to nominate projects for the North Central Texas Council of Governments (NCTCOG) Sustainable Development Program as specified in Attachment B. DISCUSSION: In the FY 2004 and FY 2005 federal appropriations bills, the City of Fort Worth received earmarks totaling $4,484,000.00 ("Urban Village Funds") in transportation funds through the Federal Highway Administration's Section 115 Demonstration Program. These funds are to be allocated for projects within designated urban villages. In addition, NCTCOG issued a call for projects on October 17 to public agencies in order to fund up to approximately $40 million in transportation improvements throughout the region ("Sustainable Development Funds"). NCTCOG has set aside $12.6 million of these funds for the Western subregion -- which includes the City of Fort Worth -- for projects around transit stations; for pedestrian -oriented infill projects in historic downtowns; and for infill projects in low-income, high unemployment, and high vehicle emission areas. On November 1, 2005, the Central City Revitalization and Economic Development Committee (CCREDC) endorsed the release of a Request for Proposals (RFP) to allocate Urban Village Funds and to nominate projects for the NCTCOG Sustainable Development Funds. In accordance with the CCREDC endorsement, the City issued an RFP on November 2, 2005. On December 1, 2005, the City received 31 proposals for urban village funding or sustainable development Logname: 55SPINKS RAMP Page 1 of 2 nomination. An interdepartmental working group -- comprised of staff from Planning, Transportation and Public Works, Economic and Community Development, Parks and Community Services, Engineering, and the T -- reviewed, evaluated, and rated each of the proposals. On December 23, 2005, the City Plan Commission (CPC) reviewed the staff evaluations and recommended funding five urban villages for planning, design and construction; and funding another seven urban villages for planning only, as specified in Attachment A. The CPC also recommended the nomination of seven projects for Sustainable Development funding as specified in Attachment B. The City Council received a briefing on these recommendations on January 10, 2006. Upon approval of this M&C, staff will complete the following activities: Urban Villaqe Proiects . Work with community stakeholders to select consultants for planning and design. . Work with TxDOT to execute appropriate funding agreements. (Staff estimates that TxDOT's administrative fees for these funding agreements will represent approximately eight percent of project costs.) . Request City Council authorization to execute planning and design contracts. Sustainable Development Proiects . Submit nominations to NCTCOG on Friday, January 20, 2006. . Report to the City Council the project selections made by the Regional Transportation Council on April 13, 2006. . Work with NCTCOG to execute appropriate funding agreements. These projects are located in Council Districts 2, 3, 4, 5, 7, 8, and 9. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, receipt of the funding, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
