AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
HARRIS PARKWAY, SITUATED IN THE JOHN F. HEATH SURVEY,
ABSTRACT NUMBER 641, CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS; CONTAINING APPROXIMATELY 24,134 SQUARE
FEET OR 0.5540 ACRES OF LAND; PROVIDING FOR REVERSION OF
FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; AUTHORIZING THE CITY
MANAGER TO EXECUTE THE CONVEYANCE OF THE RIGHT OF
WAY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Harris Parkway, situated in the John F. Heath Survey, Abstract Number
641, City of Fort Worth, Tarrant County, Texas, and being part of a tract of land described as
"Parcel 2" in a deed to the City of Fort Worth recorded in Volume 11971, Page 1142 of the Deed
Records of Tarrant County, Texas and being all of a tract of land described as "Parcel No. 5" in a
deed to the City of Fort Worth recorded in Document Number D207006356, and being a part of
land dedicated as right-of--way by Quail Ridge Estates Addition, an addition to the City of Fort
Worth, Tarrant County, Texas as recorded in Cabinet A, Slide 174 of the Plat Records of Tarrant
County, Texas, and containing approximately 24,134 square feet or 0.5540 acres of land more or
less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated
herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided bylaw.
SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in said easements are relocated at the owner's expense.
SECTION 4.
The City Manager is hereby authorized to execute a deed without warranty and the
necessary documents of conveyance of the rights-of--way described in Exhibits "A" and "B", to
the adjacent property owners for fair market value already received.
SECTION 5.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6.
That this ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Harris Parkway South of the intersection of Harris
Parkway and Dutch Branch Road; and
2. Waive any and all purchase fee value of the vacated land since commensurate right-of-way has been
received and authorize the City Manager to execute any necessary conveyance documents.
DISCUSSION:
Dunaway Associates, Inc., on behalf of the Rall Ranch, LP, has requested the vacation of the above
referenced right-of-way to replat the right-of-way with the adjoining property for future development. The
City Plan Commission recommended approval of this request at its meeting on January 27, 2010. An
acceptable replat (FS-009-197) has been received. Any existing utilities will be relocated at the applicant's
expense or retained within a designated easement along with an appropriate plat note that no permanent
structures may be constructed or placed thereon.
The City of Fort Worth (City) acquired fee simple title to the above mentioned right-of-way as part of a sale
purchase agreement (City Secretary Contract Number 33903) for Southwest Parkway (S.H. 121). In
exchange for a portion of the right of way, the City agreed to abandon and convey the portion of Harris
Parkway not used in the realignment of the right of way. The Staff therefore recommends a waiver of the
collection of the fair market value.
This land is located in COUNCIL DISTRICT 3.
