AMENDMENT NO. 2 TO AGREEMENT
FOR ARCHITECTURAL DESIGN SERVICES
FIRE STATIONS NO. 11 AND No. 41

WHEREAS, The City of Fort Worth and RPGA Design Group, Inc. (Architect) made and entered into City
Secretary Contract No. 33770 (The Contract)which was authorized by the City Council by M&C C-21547,
the 11th day of July, 2006; and
WHEREAS, further amendment is necessary to reimburse the Architect to include establishing an
easement encroachment from the west property line (northern portion) to Willow Springs Road for Fire
Station No. 41 as part of the design services agreement; and
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I — SERVICES OF THE ARCHITECT, a fourth paragraph is added to read as
follows:
"Provide additional design services to include establishing an easement encroachment farm the
west property line (northern portion)to Willow Springs Road for Fire Stations No. 41. The cost of
this additional service is $1,750.00 for Fire Station No. 41. This amendment does not affect Fire
Station No. 11. The scope of services is described more fully in the RPGA Design Group, Inc.,
letter dated December 15, 2006, subject: Fire Station #41-Easement Encroachment which is
attached hereto as Attachment"B"and made a part of this Agreement."
Paragraph 1 of SECTION V-COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of
$108,250.00 for Fire Station No. 41. The fixed fee for Fire Station No. 11 remains at$98,000.00."
All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

RE: Fire Stations #41—Easement Encroachment

Mr. Murayama:
In order that we might reach a clear understanding,please accept this as our proposal regarding
Additional Services to establish an Easement Encroachment from the west property line(northern
portion) at Fire Station#41 across and intervening property and easement to Willow Springs Road.
1) The following services will be provided by Pacheco Koch Consulting Engineers:
A. General
1. Prepare one (1) separate instrument dedication document for an access easement
required as a part of the development of the site for Fire Station#41.
B. Schedule
1. Pacheco Koch Consulting Engineers will complete the work in a timely manner upon
receipt of"Notice to Proceed" from the City of Fort Worth.
2) The City of Fort Worth shall provide full information regarding the requirements of the
Easement, and RPGA shall be entitled to rely upon the accuracy and completeness thereof,
including, but not limited to all essential information to be supplied by additional subcontractors
or consultants retained by the Owner.
3) Our proposed Additional Services fee for establishing the Easement Encroachment is $1,750.00
as indicated in the attached proposal from Pacheco Koch.
If the above reflects your understanding of our agreement,please sign two copies of this proposal and
return them to RPGA Design Group. We will then issue our consultant a Notice to Proceed.

As you are aware, Pacheco Koch has been requested to provide services on the
referenced site that we believe are outside the Scope of Work of our initial proposal
dated May 30, 2006, and subsequent additional services proposals as applicable.
These services are as follows:
OFF-SITE ACCESS EASEMENT. Pacheco Koch will prepare one (1)
separate instrument dedication document for an access easement required
as a part of the development of the site.
Included in this item:
■ Dedication statement, survey exhibit and metes and bound description for
the easement.
■ Coordination with City staff for review and approval of the easement.
Not included in this item:
■ Coordination with property owners for execution of easement. j
■ Filing of the easement.
We propose that the fee for our current contract be incr eased by,$ 9,754.00 to cover
personnel expenses involved in these changes. erml s-nd conditlo s s all be the
same as per our original agreement.
