AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE CULTURE AND TOURISM FUND IN THE AMOUNT OF $502,852.00, AND
DECREASING THE UNAUDITED, UNRESERVED, UNDESIGNATED FUND BALANCE
BY THE SAME AMOUNT, FOR THE PURPOSE OF UPGRADING THE AIR
CONDITIONING AND HEATING SYSTEM IN THE COLISEUM BACKSTAGE CLUB AT
WILL ROGERS MEMORIAL CENTER; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Culture and Tourism Fund in the amount of $502,852.00, and decreasing the unaudited, unreserved,
undesignated fund balance by the same amount, for the purpose of upgrading the air conditioning and
heating system in the Coliseum Backstage Club at Will Rogers Memorial Center.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Culture and
Tourism Fund in the amount of $502,852.00 and decreasing the unaudited, unreserved, undesignated
Culture and Tourism fund balance by the same amount; and
2. Authorize the execution of a contract with Johnson Controls, Inc., in the amount of $432,852.00 and
$70,000.00 in contingency and staff costs using a Texas Multiple Award Schedule Contract Number
TXMAS-6-840160 to upgrade the air conditioning and heating system in the Coliseum Backstage Club at
the Will Rogers Memorial Center.
DISCUSSION:
A design agreement was previously executed with Summit Consultants in the amount of $8,500.00 to
provide the design and construction administration services to upgrade the air conditioning and heating
system. The system upgrade is necessary to provide cooling and heating comfort to the clients at the
events scheduled in the Backstage Club in the Coliseum at the Will Rogers Memorial Center. The HVAC
units were ordered separately through a Type A Agreement in order to have the units manufactured and
ready to install along with the other components of the project.
PRICE ANALYSIS -The vendor prices were obtained using a Texas Multiple Award Schedule (TXMAS)
Cooperative Contract Number TXMAS-6-840160.

M/WBE - A waiver for the goal for M/WBE subcontracting requirements was requested by the Public
Events Department and approved by the M/WBE Office because the purchase of goods and services is
from sources where subcontracting or supplier opportunities are negligible.
COOPERATIVE PURCHASE -State Law provides that a local government purchasing an item under a
cooperative purchasing agreement satisfies State laws requiring that the local government seek
competitive bids for purchase of the item. TXMAS was established by the State of Texas to provide a list
of approved contracts that have been competitively bid and awarded by Federal, State or Local
Government entities to increase and simplify the purchasing power of governmental entities across the
State of Texas.
The project is physically located in COUNCIL DISTRICT 7 but will serve Fort Worth residents in ALL
COUNCIL DISTRICTS.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendation
and adoption of the attached supplemental appropriation ordinance, funds will be available in the current
operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the unaudited,
unreserved, undesignated fund balance of the Culture and Tourism Fund will exceed the minimum reserve
as outlined in the Financial Management Policy Statements.
