HomeMy WebLinkAboutOrdinance 19706-06-2011Ordinance No. 19706-06-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SOLID WASTE FUND IN THE AMOUNT OF $1,166,743.00, AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING ADDITIONAL PROGRAMS WITHIN THE CODE COMPLIANCE DEPARTMENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Solid Waste Fund in the amount of $1,166,743.00, and decreasing the unreserved, undesignated fund balance by the same amount, for the purpose of funding additional programs within the Code Compliance Department. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Solid Waste Fund by $1,166,743.00 and decreasing the unreserved, undesignated Solid Waste fund balance by the same amount; 2. Authorize the transfer of $930,026.00 from the Solid Waste Fund to the General Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Fund by $930,026.00 from available funds within the Code Compliance Department. DISCUSSION: Authorization of this M&C will approve a supplemental appropriation and transfer of funds from the Solid Waste Fund to the General Fund for reimbursement of costs associated with the enforcement of solid waste ordinances by the Code Compliance Department and increase the annual operating budget of the Code Compliance Department for staffing enhancements outlined below. The adopted budget for Fiscal Year 2011 for the Solid Waste Fund included excess revenues of $1,683,096.00. The adopted budget for Fiscal Year 2011 included a transfer of funds in the amount of $338,510.00 from the Solid Waste Fund to the General Fund for reimbursement of costs associated with the enforcement of solid waste ordinances by the Code Compliance Department. During Fiscal Year 2010, the Code Compliance Field Operations Division responded to 58,363 violations. Approximately 36.6 percent of these violations were in response to solid waste ordinance violations. The adopted budget for Fiscal Year 2011 for the Code Compliance Department Field Operations Division, excluding private mowing, is $3,460,638.00. Full cost recovery to the General Fund for costs associated with the Solid Waste Fund requires an increase in the transfer of $930,026.00.
